Man gets 55 months for role in gunfight

PHILIPSBURG--A 28-year-old man who had been involved in a gunfight in St. Peters on September 23, 2010, was sentenced Wednesday to 55 months by a judge of the Court of First Instance.

Judge Monique Keppels found it proven that Sheldon Marlon Carty had been in possession of an illegal firearm and had attempted manslaughter of F.R.L.G. (24) in a drive-by shooting that took place at the intersection of St. Peters Road, Apricot Road and Marigot Hill Road, near Milton Peters College, around 9:00am.

F.R.L.G. will have to answer similar charges, as well as three armed robbery charges. His court hearing will take place on March 23.

During the January 13 court hearing, Prosecutor Ben den Hartigh asked for five years, but Carty and his attorney Geert Hatzmann claimed that Carty had been under a lot of psychological stress and had acted in self-defence.

According to the defence, Carty had been in a feud with F.R.L.G. since 2005, after he had stolen his brother's scooter. Lawyer Hatzmann told the court that Carty and his brother had almost lost their lives when F.R.L.G. had slammed his car into the scooter on which S.M.C. and his brother were riding. The two siblings were both injured and hospitalised.

In July 2010, F.R.L.G. had allegedly fired three shots from the bushes at the car in which Carty was driving. Carty had reported the incident to the police, but considering that his assailant was not taken off the streets, he had decided to buy a firearm to protect him and his family from any new assault.

He encountered his assailant again in September last year, and seeing that he had pulled a gun, Carty had deemed it necessary to defend himself.

Judge Keppels rejected the self-defence plea, because F.R.L.G. had given a different statement concerning the previous incidents involving the two rivals. She also rejected the claim that Carty had yielded to psychological pressure.

The judge considered the prosecutor's five-year demand "suitable and necessary," but granted a five-month reduction in the sentence, because Carty had been held in detention in the police station longer than is permitted.
