Junior Carnival Parade deemed dynamic success

page1a285PHILIPSBURG--The Junior Carnival Parade kicked off on Sunday, April 22, to a colourful and vibrant start. Parading through the streets of Philipsburg, diverse schools and troupes showed off their costumes and animated dance moves to a hyped-up Carnival audience lining the sides.

Seven groups participated in this year's Junior Carnival Parade. Winning first place for the troupes was Survivors with its theme of Rhythm of Steel Pan. Troupe Nathalie Parrotte came in second and Public Schools placed third.

The first prize for floats was awarded to Survivors along with the first prize for Individual Costume.

Shooting of Ahmed Ismael: A warning to us all

 Citizens for Bahrain-It is being reported in some quarters that Ahmed Ismael who was shot dead during a protest on Saturday was killed by gunmen opposed to the opposition. We want to discuss here the significance of this allegation for Bahrain and the likelihood that this be true.Firstly, all of us should be ready to totally condemn this killing, whatever its motivations. Whatever people may think about the protest movement, Ahmed Ismael was a young man with a promising future who certainly didn’t deserve to die for attending a protest march and our thoughts are with his family.This event should come as something of a wake-up call to all of us. We have all witnessed this growing anger within our society towards the protest movement and the terrible impact that the instability has had on our country. Many of us know hot-headed people (whether loyal or opposition) who have taken to sectarian insults – something that had previously been strange and unacceptable for Bahraini society.We do not yet know for sure who shot Ahmed Ismael. However, while this killing may have shocked us; we may not have been surprised.We live in a society that has become increasingly brutalized in recent months. When we see videos of police being showered with Molotov in locations familiar to us, and when the streets fill with tear gas, we ask in incredulity: Is this really Bahrain?We have spoken to the loved ones of policemen killed and disfigured in ambushes and listened to their anger and bafflement about what is occurring here. Why are children as young as nine or ten being taught to make explosives and build roadblocks? Have we all gone crazy?In this sense, there was a degree of inevitability that a handful of those angered by the excesses of the opposition would violently take matters into their own hands. However, there is also inevitability about where such actions will take Bahrain if they continue.Around 2005 Iraq dissolved in a frenzy of sectarian violence, which escalated following the destruction of the Gold-domed Samarra Mosque and shrine for the Imams Al-Hadi and Al-Askari in February 2006. Let’s not even try to imagine the horror of such an outbreak of sectarian violence in tiny Bahrain, where culture and geography dictate that we all live so close to each other.Thus, even though some people reading this article may understand the anger that may have driven someone to open fire on a protest march; for this same reason it is all the more important that we take a stand in condemning this outrage. If we feel anger towards the protestors it is because of the consequences of their actions for Bahrain; likewise we must also condemn whoever killed Ahmed Ismael for the possible consequences of their actions for Bahrain.The wise response to this outrage should be a united Bahraini call for all sides to stop trying to achieve their political goals on the streets, or ridiculous attempts to muster as many people as possible for their political marches – as if this proved anything. Rather, this makes dialogue and reaching a peaceful consensus a national obligation. This is why we say clearly to both Al-Wefaq and the National Unity Gathering: Stop erecting preconditions for talks and get back to the negotiating table – sooner rather than later – for the sake of Bahrain.

Joint Court orders early release of two convicted drug smugglers

~Judges rescind ministerial decision~

PHILIPSBURG--The Joint Court of Justice ordered the immediate release of two men Wednesday. They had been sentenced on appeal to five years and six months on March 24, 2011, for drugs smuggling.

Both men are foreigners and had appealed for early release. They also filed for appeal against their convictions at the High Court in The Hague, which is still to decide on their cases.

Minister of Justice Roland Duncan turned down the requests for early release, based on a policy that conditional release will not be granted to foreigners who are sitting out prison sentences of five years or longer.

The three judges of the Court of Appeals, however, came to the conclusion that the minister's policy is against the law.

Minister Duncan had introduced the new policy on 10-10-10 to combat illegal residence in St. Maarten and to curb the nuisance caused by criminal foreigners. The minister did not want to give the impression that St. Maarten is a country in which foreigners can commit serious crimes and jeopardise safety without carrying the consequences of sitting out the full length of their sentences. "St. Maarten cannot give the signal that crime pays," according to the Minister of Justice.

The Criminal Code provides in the early release of prisoners, upon the Minister of Justice's discretion. In deciding on such requests, the minister should adhere to principles of good governance.

In connection with his policy, the minister had referred to the National Ordinance Admission and Expulsion LTU and the ministerial order on electronic supervision.

The Appeals Court stated in its ruling it could not follow the minister in this standpoint, because the LTU is referring to the minister's authority on the issuance of temporary residence permits, and the expulsion and detention of illegal immigrants. The LTU does not apply to the early release of foreigners, the Joint Court stated.

The minister's authority to apply electronic supervision is also a separate and independent authority, next to his authority to decide on conditional release, the judges said.

During the April 11 closed-door hearing in this case, the minister's legal representative, attorney A.G. Baly, had submitted the Court with an undated and unsigned "internal" Ministry of Justice document, which contained criteria to assess requests for conditional release. In this document it was stated that no conditional release would be granted to foreigners who are convicted of prison sentences of five years or more.

According to information provided on behalf of the Minister of Justice this document was only distributed among the authorities concerned, among which were prison management, probation officers and the Prosecutor's Office. According to the Appeals Court it could not be ascertained whether the contents of the documents were also known among detainees and the population at large.

According to Minister Duncan the policy had been introduced on 10-10-10, and Joel J. Mark (42) of Grenada and Gerald R. Collet (44) of France had been the first to apply for early release under this scheme. This led the Appeals Court to the conclusion that it does not concern a lasting and established policy.

In the decisions to turn down the requests of early release, which were issued on January 30, and which were rescinded by the Appeals Court on February 16, it was stated the requests were denied because it would be impossible to keep requestors under supervision because they were illegal residents and would be expelled from St. Maarten.

In their decision, the Appeals Court judges also took into consideration that the prison and probation officer had given positive advice to the minister concerning the early release, and had indicated that both men's behaviour in jail had been exemplary.

The judges hereby also pointed to the fact that prison staff and probation officers had apparently not been aware of the minister's policy on early release. Therefore, the prisoners were confident their requests would not be categorically denied because they were foreigners, the Appeals Court stated.

Liens on Robbie’s bank accounts lifted

WILLEMSTAD--The Appeals Court has lifted the liens on three bank accounts under the name of suspect lottery boss Robbie dos Santos, who was taken into custody on Tuesday.

The US $30 million liens placed on American bank accounts of three suspected legal entities in the Bientu case will remain in place, Prosecutor Guillano Schoop said Wednesday morning.

The liens on Dos Santos' three bank accounts were placed upon the order of the Prosecutor's Office in July 2011. They were approved by a Judge of Instruction. The liens on the legal entities' accounts followed later.

Schoop did not mention their names Wednesday, but during a press-release issued last year, the Prosecutor's Office stated that apart from Dos Santos and a co-suspect, a number of connected legal entities were also suspected of money laundering, tax evasion and forgery. It concerned, for instance, offshore company Caribbean Investment Group Ltd. in Anguilla and Jamaroma Lotteries N.V.

Attorneys-at-law Wouter Tielkemeijer and Eldon "Peppie" Sulvaran had filed a complaint against the lien. The handling of the complaint took some time, but in the end the court decided in their client's favour. The lien on the legal entities remained in place.

The Prosecutor's Office called in Robbie dos Santos for questioning on Tuesday morning. Upon his lawyers' request, the hearing was postponed until Wednesday morning.

After he had reported with the authorities, the lottery manager was arrested. Six hours later he was taken into custody.

Dos Santos was also questioned in October 2011, after which he was sent home. The main offices of Robbie's Lottery in Curaçao and St. Maarten and Dos Santos' house in Brakkeput Abou were searched in July 2011. He had gone on vacation that day and did not return for three months. Dos Santos returned to Curaçao from the Dominican Republic in October 2011. He was questioned almost immediately thereafter.

Lottery manager sentenced for gun

PHILIPSBURG--Robbie's Lottery manager Jacques de Castro (52) was sentenced Wednesday to 12 months suspended, with two years' probation for keeping an unlicenced firearm in a drawer of his office desk.

De Castro will also have to pay a NAf. 1,500 fine. In case he would not pay this fine, he would have to spend 60 days in prison.

His lawyers Eldon Sulvaran and Jairo Bloem had claimed the search of the lottery office was illegal and, therefore, the case against their client should be thrown out.

Judge Monique Keppels rejected this claim, and stated the documents which the defence lawyers had wanted to see concerned the cases against Robbie's Lottery's boss Robbie dos Santos, Caribbean Investment Group Ltd. and Jamaroma Lotteries NV.

The fact that the defence lawyers were not able to see these documents, therefore, did not constitute a violation of their client's rights, the Judge stated.

Judge Keppels found it legally and convincingly proven De Castro had been in possession of a .380 calibre Jennings firearm and ammunition that were found during a search of the Robbie's Lottery office on Cannegieter Street on July 12, 2011.

Members of the Kingdom Detective Cooperation Team RST paid a visit to Robbie's Lottery headquarters as part of a major investigation headed by RST and assisted by the Intelligence and Investigations Team (TIO) of the Foundation Tax Accountants Bureau in connection with an investigation into money-laundering, tax fraud and forgery in Curaçao and St. Maarten.

The so-called "Bientu" investigation, which was launched in 2008, also focused on Caribbean Investment Group and Jamaroma.

De Castro, who was held for 10 days, was not charged with involvement in any financial crimes.

Observers tour Damascus area as bombing continues in Homs

The UN observers overseeing a fragile ceasefire in Syria on Monday began their second week of mission with trips to the outskirts of the capital. The peacekeepers are around Damascus, said Neeraj Singh, an official of the UN advance team. He said they visited the rebel city of Zabadani, 47 km northwest Damascus, a regular flashpoint of anti-regime demonstrations and clashes between government forces and the Free Syrian Army (FSA).

Lottery boss released

WILLEMSTAD--Lottery boss Robbie dos Santos has been freed from custody in Curaçao, but remains a suspect in the "Bientu" (wind) investigation.

The owner of Robbie's Lottery has to report for questioning on set days, must remain available to Justice authorities at all times and has to inform the Prosecutor's Office if he intends to travel abroad.

The attachment on the American bank accounts of three suspected legal entities in the case remains, Prosecutor Guillano Schoop confirmed. It regards almost US $30 million.

The court itself had lifted the attachment on the three accounts under the suspect's name. With authorisation of an examining judge, the prosecution first had targeted three bank accounts under Dos Santos' name in July last year, followed by the accounts of the legal entities involved later on.

Schoop didn't mention the names of these legal entities, but it had been stated earlier that besides Dos Santos and a co-suspect, several legal entities also were suspected of money laundering, tax evasion and forgery. It regards, among other entities, Caribbean Investment Group Ltd. and Jamaroma Lotteries N.V. The former is known to be an offshore company domiciled on Anguilla.

Attorneys Wouter Tielkemeijer and Eldon "Peppie" Sulvaran had filed a complaint against the attachment of the personal accounts. Although the handling of this appeal had taken some time, the ruling turned out in favour of their client, although the attachment on accounts of the legal entities remained.

Dos Santos received a summons last week Monday to report for interrogation on Tuesday. At the request of his attorneys, this was postponed to Wednesday morning. After six hours of questioning the lottery boss was taken into custody for 48 hours at the most.

Had the prosecution wanted to keep him longer, a request for further detention for eight days would have been submitted for the examining judge to decide on Saturday, but this was not the case.

Dos Santos had already been heard in October last year and released afterwards.

Raids at the head offices of Robbie's Lottery in Curaçao and St. Maarten, and at the residence of the lottery boss at Brakkeput Abou were conducted in July last year. Dos Santos had left on holiday the day before and did not return for three months.

He returned to Curaçao from the Dominican Republic in October and was heard almost immediately afterward.

Chief Prosecutor not amused by release of Simpson Bay detainees

PHILIPSBURG--Chief Prosecutor Hans Mos said Tuesday it was "very undesirable and awkward" that crime suspects are being released from detention because they cannot follow the daytime programme at Pointe Blanche prison to which they are entitled.

Mos said this in reaction to the Judge of Instruction ordering the immediate release Friday of three crime suspects who were held at the Simpson Bay Police substation.

Judge Coen Luijks lifted their detention because they had not been transported to Pointe Blanche prison to follow the daytime programme for detainees, which includes recreation.

The Prosecutor's Office had appealed Friday's Court decision to release L.G. (26) of St. Kitts, who is suspected of (armed) robbery and possession of an illegal firearm. However, the Appeals Court on Tuesday confirmed the Judge of Instruction's decision to order the man's release.

"This is very painful," said Mos. "The police have gone through a lot of trouble to arrest this man. He confessed to sixteen robberies. Because he cannot follow the day programme we were forced to release him. He has been handed over to the Immigration Department and will probably be sent home to St. Kitts. The only consolation we have is that he has been handed a summons to appear in Court on May 2 to face charges."

More bad news followed Tuesday with the Judge of Instruction also ordering the release of suspect V.W., who is allegedly involved in drugs. He was arrested March 29 in connection with 166 kilos of marijuana found inside a van which was parked at Le Grand Marché parking lot.

In a ministerial decree of December 21, 2011, Minister of Justice Roland Duncan designated the Simpson Bay Police substation and the new cells at the Philipsburg Police station as houses of detention for suspects awaiting their trial. In this decree the minister confirmed the right of detainees to be transported to Pointe Blanche to follow the day programme and to receive visitors during weekdays.

During the hearing of V.W.'s case, Prosecutor Gonda van der Wulp did not contest, and even admitted he was not transported to Point Blanche to follow the day programme. The Prosecutor, however, claimed this situation had been caused by events that had been out of the Prosecutor's Office's control.

She claimed the April 10 riot at the Simpson Bay substation had prevented V.W. from being transported to Pointe Blanche in a timely manner.

The Judge of Instruction rejected this argument in pointing at the fact that the riot had only taken place during part of that day, while the detainee had not been taken to Pointe Blanche for 10 days.

Chief Prosecutor Mos confirmed that detainees are entitled to certain facilities while being held in detention. "Detainees have the right to be taken to Pointe Blanche to make use of the prison facilities. This has not happened, possibly due to a lack of personnel."

He confirmed statements made by Prosecutor van der Wulp in Court that, in the meantime, a day programme has started in Simpson Bay.

Mos qualified the Judge of Instruction's sanction as being very severe. "One should also look at the merits of the case. In the past, persons who were held at the old police cells, which also didn't have a day programme, were compensated with a month reduction on their prison sentence for every week they had spent under such regime. The Judge of Instruction could have meted out a similar sanction in these recent cases, but instead ordered immediate release."

Mos also asked for some understanding for the situation under which justice officials have to work in young country St. Maarten. "The minister of justice is not a wizard. We still have to cope with the means that were provided by the former Netherlands Antilles, which have been very meagre. The situation with the old police cells has been rectified, and things are slowly improving. We are looking into possibilities to rectify the problems with the daily programme," the Chief Prosecutor said.

Prison director Rudsel Ricardo declined to comment or to answer any questions concerning the day programme and the transport of detainees. "This is a complicated situation in which all noses should be pointing in the same direction," he said in referring questions to the Chief Prosecutor.

Gendarmerie reports on two accidents Saturday

~ Clarifies details after rumours circulated ~

MARIGOT--The Gendarmerie denied Sunday that one of its patrol vehicles accidentally had run over a child who subsequently was treated for unspecified injuries.

Capitaine Jouault explained there were two had been separate accidents on Saturday, one in French Quarter at 11:00am and one in Sandy Ground, both involving patrol vehicles.

In Sandy Ground a child fell off a bike as the Gendarmerie car was passing, but at no time did the vehicle hit the child, Jouault explained.

"It was material damage only," he said. "I don't know where this information came from that the child was hit by a car."

The other accident involved a Gendarmerie vehicle chasing a motorcycle rider who was not wearing a helmet, in French Quarter. The driver lost control of the Gendarmerie vehicle during the chase and the vehicle hit a wall.

Frente Sivíl to submit integrity file to Asjes

~ 'Three cabinet members unfit to be minister' ~

WILLEMSTAD--On behalf of pressure-group umbrella organisation Frente Sivíl, Onny Gonet is to submit documents to President of Parliament Ivar Asjes today, Monday, to prove that at least three members of the Schotte cabinet are not fit to be ministers.

Frente Sivíl is taking this initiative after none of the 21 Members of Parliament (MPs) put their weight behind the organisation's motion calling for government to be sent home.

According to spokesman Ruben Suriel, the meeting, which is planned for 8:45am, is in reaction to what transpired in Parliament, on March 7. Pressure group Akshon Dushi Kòrsou held a presentation that day and requested Parliament to launch an investigation into the integrity of members of the Schotte cabinet.

A majority in Parliament opposed the idea and several MPs accused the pressure group of making unfounded allegations against cabinet members. The reproach was reason for Frente Sivíl, of which Akshon Dushi Kòrsou is a part, to collect data about the wheeling and dealing of members of the Schotte cabinet.

According to Suriel, facts have recently been collected about Prime Minister Gerrit Schotte and his MFK party members Finance Minister George "Jorge" Jamaloodin and Minister of Economic Development Abdul Nasser El Hakim.

It involves courts verdicts in which the prime minister was involved, among other things.

Suriel was quick to state that Frente Sivíl would not present this information as evidence. "It involves information which has been made public recently. We want the ministers concerned to indicate whether the information we have obtained is correct or not," Suriel said Saturday morning.

The documents that will be handed over to Asjes are supposed to increase pressure on Parliament to pay serious attention to the integrity issue, Suriel stated.

The documents will also be sent to MPs. It will be up to them to have this information studied and verified.

Frente Sivíl is to reveal the contents of the dossier, during a public meeting to be held during the course of the week. The action group wants to increase pressure even further, should Parliament decide to do nothing with these documents. A large-scale protest demonstration has been scheduled for the end of April, for which Frente Sivíl wants to mobilise between 15,000 and 20,000 protesters.

The demonstration aims to deliver a strong message to government and Parliament, indicating that a large part of the community is in favour of new elections.

Frente Sivíl claims Schotte committed punishable acts

WILLEMSTAD--During his entire career, Prime Minister Gerrit Schotte (MFK) has been guilty of "manipulative, evil and even punishable" acts, it was stated in a letter from Frente Sivíl to President of Parliament Ivar Asjes (PS).

The letter accompanied a dossier that would contain a number of disreputable cases in which the MFK-leader would have been involved.

Frente Sivíl expressed its hope that the 21 Members of Parliament (MPs) would use the file to send Schotte and his government home to "save the fatherland."

Frente Sivíl's file was drafted after pressure group Akshon Dushi Kòrsou was criticized during a presentation to Parliament for levelling unfounded accusations against Schotte and other cabinet members.

In a lengthy enumeration, based on verdicts and statements of persons involved, Frente Sivíl is going as far back as Schotte's secondary school days. He would, for example have been expelled after he committed fraud with the exams. This would, according to Frente Sivíl, prove that Schotte's manipulative character had already developed at an early age.

Frente Sivíl also reported court cases in which Schotte would have been sentenced for embezzlement and fraud with credit cards. The current Prime Minister would also have been involved with a number of companies that were declared bankrupt, and with bad cheques. He would also have allegedly been involved with a restaurant that would have accepted payment without delivering the food that was ordered.

Schotte would have been deeply indebted, which would have led to a lien that was put on his salary while he was a commissioner. The lien would only have been lifted through the intervention of a befriended female politician, "who is currently involved with different political functions," Frente Sivíl claimed.

The verdicts allegedly would make it clear that a lien was placed on Schotte's salary because of irregularities. As a Lido Hotel employee he received a salary of NAf. 2,000. Several months later, after he had been hired as an assistant by his late-father-in-law and minister Richard Salas, he received a salary of NAf. 7,000, plus an allowance of 25 per cent.

However, the salary of an assistant should consist of his previous salary, plus 25 per cent, or a salary depending on education, and 25 per cent. Frente Sivíl derived at the conclusion that Schotte was not entitled to his salary.

Frente Sivíl also reported that Schotte would be having "millions" in an Orco Bank account. The persons making deposits in this account would be current supervisory board members of government N.V.s. Frente Sivíl is stating this concerns "unusual, conflicting, and even punishable acts."

One of the persons depositing money in the account would be the one who is benefiting from the fact the Schotte cabinet prohibited the sale of Fun Miles at gas stations, the pressure group umbrella organization is stating. Frente Sivíl is also wondering if taxes were paid over these amounts.

Frente Sivíl also reported a deadly accident, in which the "speeding" Schotte would have been involved, and a "suspicious" burglary at Schotte's home. Investigations

Austerity talks collapse after PVV walks out

~Election now likely~

THE HAGUE--Austerity talks between the minority coalition consisting of People's Party for Freedom and Democracy VVD, Christian Democrat CDA and Party for Freedom VVD collapsed Saturday afternoon, when PVV leader Geert Wilders walked out. New elections are now very likely, Prime Minister Mark Rutte told reporters.

In a news conference shortly after Wilders left the negotiations, both Prime Minister Mark Rutte and CDA leader Maxime Verhagen blamed the collapse on the PVV leader.

"At the last moment, the PVV was shocked about the impact of the consequences of previously made agreements," Rutte said.

Verhagen said all hopes of an agreement had been dashed. The PVV leader has "left 16 million Dutch people in the lurch," he said.

The Telegraaf newspaper reported that Wilders felt he had to withdraw from the negotiations after discussing the austerity measures with other PVV officials.

The talks between the coalition and its alliance partner resumed on Saturday to assess the results of a financial analysis of the austerity measures.

In a brief statement, Wilders said he could not accept that pensioners would have to pay for "useless" demands from the European Union. Agreeing with the measures is "not in the interest of our PVV voters," he said.

Labour PvdA leader Diederik Samsom said new elections were now inevitable. "Everyone will have to share in the consequences of the crisis," he said.

However, if there would be an election, it would unlikely to take place before September. This means the minority government would continue in a caretaker function until then, but would be unable to take significant steps to revitalise the economy without parliamentary approval.

In particular, it is unclear what the implications would be for the 2013 budget, on which the coalition alliance had spent the past seven weeks working towards. The budget is always presented on the third Tuesday in September.

An opinion poll published Sunday showed The Netherlands remains highly fragmented politically, suggesting that it could prove difficult to form a new coalition quickly and that Wilders' chances of forming a new government were slim.

The Maurice de Hond poll, conducted after the budget talks collapsed, showed that no single party would obtain a majority if elections were held now, although Rutte's VVD Party has strengthened its lead, followed closely by two leftist parties.

The poll also showed that a majority favour smaller budget cuts than those stipulated by the European Union, a further sign that the notoriously frugal Dutch are suffering from "bailout fatigue" and resent the high cost of rescuing profligate peripheral euro zone countries.

"Voters from different parties share the same view; disgust or disappointment over the political action and the political parties," De Hond said in a statement, adding that two thirds of those polled agreed with the statement: "I'm tired of all the party politics."

Fifty seven per cent of respondents agreed with The Netherlands cutting less than the European Union wants. Supporters of the populist PVV and of Socialist Party (SP) were particularly set against cuts.

The poll showed the Dutch were most strongly opposed to spending cuts that would have a direct impact on standards of living; 56 per cent of respondents opposed the introduction of a new, modest prescription charge, and 47 per cent opposed an increase in value added tax.

The cabinet is set to meet today, Monday to discuss what it should do next to agree on a budget and whether to resign. The Queen could accept its resignation, paving the way for elections, or ask the Prime Minister to form a new coalition.

If elections were called, the VVD would win 33 seats in the 150-seat Second Chamber of Parliament, up from 31 now, the poll showed, followed by the euro-sceptic SP with 30 seats and the pro-Europe PvdA with 24 seats.

Rutte's coalition partner CDA and the PVV, until Saturday his main allies, have both slipped in the polls and would win 11 and 19 seats respectively.

Island Council in favour of NuStar Terminal expansion

~Concerns about airport runway~

ST. EUSTATIUS--The Island Council of St. Eustatius has voted in favour of the amendments in the Spatial Development Plan to accommodate expansion of NuStar Statia Terminal in Cul-de-Sac, but also expressed concerns regarding the consequences for the extension of the airport runway.

Reuben Merkman explained the position of the Democratic Party (DP) and said his party had always supported Terminal expansion behind The Hill, and if this would not be possible in Cul-de-Sac.

He said to have been disappointed in the previous coalition government providing little information to the general public and the Island Council. More information would have given the opportunity for a larger debate.

He explained the Island Council had been informed about the terminal expansion in Cul-de-Sac in November 2011 through a letter of intent signed by NuStar's vice-president of international operations David Smith with the previous Executive Council.

Leader of St. Eustatius Empowerment Party (STEP) Franklin Brown accused Merkman of confusing the general public by his statements in an article in The Daily Herald of April 11, in which the DP leader had stated the terminal expansion was "no done deal."

Brown questioned Merkman whether the DP government was now re-negotiating the financial agreement with NuStar, since the DP had disapproved the present financial agreement.

Brown also wanted to know the status of the present Island Council meeting, whether it was to give a clear position on the expansion or whether they were to determine whether permits should be issued or not.

He went on to state that if Merkman was that displeased with the financial agreement, his party, which holds the majority in the Council, could determine whether the project should proceed or not.

Councilman Reginald Zaandam of United People's Coalition (UPC) acknowledged the various groups in the community among those in support of the project, but disagreeing with Cul-de-Sac based on the historical findings and the closeness to the residential area.

"And then there are those who don't wish to see the tanks at all. The UPC is in favour of investors coming to the island to make it self-sufficient," Zaandam said, who acknowledged the challenges faced in developing the island. "But this should not hamper us to look over the fence for other investment possibilities."

Zaandam said the NuStar expansion should not hamper the airport runway expansion of up to 700 metres to be able to turn F.D. Roosevelt Airport into a "satellite airport" to alleviate congestion in St. Maarten.

Zaandam said the coalition had discussed several options for the terminal expansion with NuStar and had sought to address the overall interest of the island and its people.

Independent Island Council Lady Millicent Lijfrock said to be "totally in favour of this project," but also supported Zaandam's position that the expansion should not hinder the airport.

Although she supported the fact that Statians are becoming more vocal on issues, she also cautioned the public not to be one-sided. "Everything we do in life has a risk," she said.

She also acknowledged that governments in the past had failed to assure that NuStar would be a "good corporate citizen." She suggested the island government to establish a Corporate Social Responsibility, similar to what is being applied to companies in Europe.

She thinks it's important to diversify the economy, and for this reason said it would be good to go back to the negotiating table with NuStar.

Commissioner Glenville Schmidt explained the adaptation of the Spatial Development Plan was an important step in facilitating NuStar's expansion.

The Commissioner said the discussions had been ongoing for two years, but the people had not been sufficiently involved. He said the Island Council was the ultimate body to decide what was best for the island. "All present and previous council members could have brought this issue to the floor of the council," Schmidt said.

The Commissioner questioned if one should stand still because of safety concerns. "Everything we do has safety risks; taking the airplane, driving to work et cetera. The Island Government has made a decision to go forward with this project, and I will not flip-flop on this issue. We need to create more possibilities to stand on our own," Schmidt firmly stated.

Commissioner Koos Sneek outlined a number of points and answered the many questions put forward by the opposition. He said the Spatial Development Plan had been approved by the Executive Council on April 13. A letter of intent was signed by NuStar and former commissioner Clyde van Putten on October 27, 2011, in which it was stated that the company would pay US $50 million over a 10-year period, with the first payment being made in 2012. The island would also benefit from an increase in anchorage fees to US $750,000. Sneek said government is looking into the possibility of creating a trust fund.

Commissioner Sneek reiterated Merkman's statement that the DP had always been in favour of expansion of the terminal behind the hill. However, alternative locations, such as Venus Bay, proved not to be feasible, because these would be more destructive to nature.

Sneek underscored that experts will be assisting Statia for a year to draft a calamity management plan. He hoped the physicians who objected to the expansion in the farm would also get involved.

Sneek also touched briefly on the airport runway and said the terminal would not allow extension of the runway. At the same time he questioned if the island really needed a longer runway. He used St. Barths as an example of a small airport which accommodates 20 flights, bringing in approximately 300 people on a daily basis. Sneek added that petitioners would also have complained if a large jet would have come to the island.

Sneek concluded his remarks in expressing his concerns about objective media reporting. He made reference to the first demonstration against the terminal expansion, which noted that 200 persons were present, while "the facts showed that approximately 50 persons were in the walk," Sneek said.

Some 1,300 objections were filed against the draft Spatial Development Plan, 238 of which were counted as valid individual objections. Signatures collected in signature drives were not included in the count, Sneek explained.

St. Maarten members ‘committed’ to investigating any lapses at bank

page3a285PHILIPSBURG--All St. Maarten members are "committed to investigating any lapses in policy or integrity" of the management of the Central Bank of Curaçao and St. Maarten (CBCS), St. Maarten Supervisory Board member Robbie Ferron said following Saturday's more than six-hour long board meeting in Willemstad.

Ferron told The Daily Herald that criticism levelled against the St. Maarten board members, which includes Jairo Bloem and Marciella Illidge, that they were not in favour of looking into claims by Curaçao counterparts about lapses in integrity and adherence to policy by the bank's management is simply untrue.

The Curaçao members on the bank board did attend Saturday's meeting, despite earlier statements that they would boycott it.

Ferron said all seven members were present and "a lot of matters" were covered during the lengthy meeting. The board's seventh member Robert Pietersz played "a balanced role" in the proceedings. Another meeting of the supervisory board will be held in the near future; a date is still to be set.

The approval of the minutes of a management meeting of March 7 is still pending approval by the supervisory board. The minutes were a sticking point before the meeting and continue to be because Curaçao board members Renny Maduro, Glenn Camelia and Lincoln James believe some matters, such as the bond, might be unlawful.

"There is no finality about it [the minutes] because of the complexity of the problems," Ferron said, explaining that the complexity has to do with the varying opinions on the issuance of the bond to the harbour and whether it fits with the bank's investment guidelines.

He explained that what is referred to as the bank's "investment policy" is more of a guideline for investment than a fixed policy. Those guidelines are determined by the bank's analysts on the merits and risks of proposed investments.

Whether the issuance of the harbour bond and that for Curaçao utilities company Aqualectra was outside of the guidelines for those particular investments by the Central Bank will be investigated. "It's a complicated process," repeated Ferron.

The St. Maarten delegation was pelted with eggs by protestors outside of the Central Bank headquarters in Curaçao where sentiments ran very high against a US $150 million bond issued by the bank for St. Maarten Harbour Group of Companies. The protestors, some 300 in total, were from Curaçao government coalition party Pueblo Soberano (PS).

Ferron said this was not the way to treat or be treated by partners in the financial regulatory institution.

Acting Governor Lopes takes oath

page13c281ST. EUSTATIUS--Kenneth Emanuel Lopes was sworn in as St. Eustatius' new Acting Island Governor, during a brief ceremony at the Governor's Office, on Tuesday afternoon.

Born in Aruba on April 25, 1945, Kenneth Lopes is the son of the late Esmay John and late veteran-politician Vincent Astor Lopes. He moved to Statia when he was four years old and attended kindergarten and elementary school here. After completing his secondary education in Aruba, he furthered his studies in The Netherlands, where he focussed on municipal and constitutional law.

After graduating in 1969, Lopes returned to Statia, where he worked in public service until May 1973. He moved to St. Maarten, working as Head of the Department of Labour and Social Affairs and as Government Mediator of the Windward Islands, until October 10, 2010.

After his retirement, Lopes re-established himself in Statia, which, he said, he had always considered home.

Lopes said he was "honoured and humbled" by his appointment as Deputy Governor. "I am both appreciative and thankful for the trust the local government as well as the Kingdom Government have in me. I will adamantly uphold the Constitution and all relevant laws, regulations and policies of the island of St. Eustatius."

Lopes was sworn in by Dutch Government Representative Wilbert Stolte, witnessed by his brothers and sisters, as well as Governor Gerald Berkel.

More than 30 dead in Syria as observers avoid rallies

Thousands of Syrians protested Friday against President Bashar al-Assad and challenged the team of international observers already on the ground to monitor a cease-fire established by the plan of international envoy Kofi Annan. Parliament critical of Schotte letter

WILLEMSTED--The position of Prime Minister Gerrit Schotte, that organs of government-owned companies and limited liability companies are not obliged to report to Parliament, drew criticism from various factions in Parliament.

According to PS leader Helmin Wiels, Schotte's coalition partner, the government is out to create problems with Parliament, while PAR member of Parliament Pedro Atacho said he believes that Schotte is confused.

In a letter to President of Parliament Ivar Asjes, Schotte said that, "organs of the government entities, in this case the board and/or supervisory boards are not required to provide information directly to Parliament." The Prime Minister argues that this should be done only via the responsible minister. The prime minister based his assessment on Article 28; paragraph three of the Constitution of Country Curaçao. This article states: "Ministers are accountable to Parliament."

Wiels, in response, said that Schotte's letter was not well thought out and unnecessary. He said the letter tells him that either government has something to hide or that government wants to challenge Parliament. "The first is completely unnecessary and the second is not advisable," said Wiels.

Atacho said Schotte is confused and stressed that Parliament is entitled to this information. If this is requested through the Central Committee for example, he said it is not the intention for Parliament to engage in a debate with government companies or NVs, simply to obtain information. The boards, he said, represent the companies "out of court" for which the minister is not responsible.

Three Syrian officers killed as humanitarian crisis deepens

Three Syrian officers were killed Tuesday near Damascus, reported state media and the opposition. Meanwhile, a bombing attack left three injured in the center of the Syrian capital, further undermining the cease- fire declared April 12.

The official news agency SANA reported that an "armed terrorist group" killed two army officers Tuesday. A third was killed in the district of Barzeh in Damascus, according to the Syrian Observatory for Human Rights (SOHR).

Sehnaoui dares March 14 MPs to seek confidence vote

By Hasan Lakkis - BEIRUT: Telecommunications Minister Nicolas Sehnaoui dared March 14 lawmakers Monday to seek a vote of confidence in him for refusing to provide security services with telephone communications information on the pretext of protecting people’s privacy. In an exclusive interview with The Daily Star, Sehnaoui reiterated that the Telecommunications Ministry cannot provide to anyone “all data” in line with a Cabinet decision. Asked to comment on some March 14 MPs who said they might seek a vote of confidence in him during next week’s three parliamentary sessions on the government’s performance, Sehnaoui said: “If they are honest with themselves, I call on them to demand [a vote of] confidence. But I am afraid that they are not honest with themselves.” Sehnaoui’s remarks came as the row over the so-called “telecoms data,” which enables the tracking of telephone communications, escalated in the country following last week’s failed attempt to assassinate Lebanese Forces leader Samir Geagea. The incident has fueled fears of a return to a wave of political assassinations that rocked Lebanon following the 2005 killing of ex-Prime Minister Rafik Hariri. A senior security source told The Daily Star last week that the Telecommunications Ministry had turned down repeated requests since Jan. 15, including a request last week following the attempt on Geagea’s life, to provide security services with telecoms data on the pretext of protecting the people’s privacy. In the interview with The Daily Star, Sehnaoui said that he receives daily sometimes up to 300 requests for telecoms data from several security agencies and that he approves them in line with a mechanism stated by the law. But he stressed that his ministry cannot provide to anyone “all data” without the approval of a judicial committee made up of three top judges in Lebanon in line with a Cabinet decision. “What the Lebanese should know is that the security services had in the past obtained all [telecoms] data from the Telecommunications Ministry in violation of the law and the Constitution,” he said. “I brought up this issue in the Cabinet, saying that the citizens’ privacy and freedom should not be violated,” Sehnaoui said. “During a session on Feb. 1, the Cabinet decided that all data, or comprehensive information about the [phone] contacts of all the Lebanese, must go through the judicial committee made up of three top judges in Lebanon,” he added. “The Lebanese must know that this committee was not set up in an arbitrary manner ...
