Postal Services staff get payslips, but no money

~ Union threatens to file injunction against PSS ~

PHILIPSBURG--Postal Services St. Maarten (PSS) workers have received payslips for their November salaries, but no money.

When contacted for comment on Wednesday, PSS Head Denicio Richardson said he had no comment while the matter was being resolved.

St. Maarten Communications Union (SMCU) President Ludson Evers told reporters yesterday that the workers had informed him last week Friday that they had not yet received their November salaries. If this situation persists today, Evers said, the union will be forced to file an injunction against PSS by tomorrow, Friday.

Evers said that when contacted, Richardson had told the union he was not aware of the situation. When Nieuwe Post Nederlandse Antillen (NPNA) head Franklin Sluis was contacted the union was told that PSS had not submitted the relevant information needed for payments to be made.

Evers said that based on the agreement signed between the parties recently, NPNA had agreed to cover all the "shortfalls" pertaining to PSS' operations in the form of a zero per cent interest loan repayable over a six-month period in 2012.

However, for NPNA to make payments to cover the shortfalls, PSS has to submit the relevant information indicating the amount it was unable to cover for the month in question. Evers said NPNA would then make payment within eight days.

What is strange about this entire situation, he said, is that PSS staffers had received their November salary payslips from NPNA, while they were now under the employ of PSS. He said the union had to look into this matter, as receiving payslips from NPNA could mean that the workers were still working for NPNA, which he said was not the case.

Evers said the salary tab for PSS workers was between NAf. 96,000 and NAf. 100,000 per month.

Teen arrested as suspect in supermarket robbery

COLE BAY--Police arrested a fifteen-year-old boy on suspicion of armed robbery at Daily Extra Supermarket on November 19.

The supermarket was robbed by two men armed with a shotgun and a handgun around 8:45pm. One of the robbers struck an employee on the head with one of the guns. The employee was taken by ambulance to the hospital later for treatment. After collecting enough goods the men drove off in a small black vehicle.

A Simpson Bay police patrol was called shortly after the robbers had left. When officers arrived they conducted a search of the area and they found a vehicle with licence plate 3232AAA971 that matched the description of the robbers' car.

A teenager identified as K.D. (15) of St. Martin was found sitting in the car. Officers searched the vehicle and found a loaded shotgun lying on the back seat. The shotgun was confiscated and police plan to run tests on it.

K.D. was arrested on the spot and taken to the Philipsburg station for questioning. He remains in police custody.

Unofficial results: Muslim Brotherhood leading in Egypt parliamentary elections

Egypt's Muslim Brotherhood was leading in initial, partial results from the country's parliamentary elections. However, it was facing strong competition in many provinces both from more hard-line Islamic groups and from a liberal-secular alliance, the AP quoted sources as saying on Wednesday.

Counting is still continuing from the first round of voting, which took place on Monday and Tuesday. Initial results are not expected before Thursday evening.

Police arrest suspect in murder case, other man

BELVEDERE--Police arrested two men near the border at Belvedere around 4:00pm yesterday.

Reports reaching The Daily Herald last night said one of the men was believed to be a suspect in an open murder investigation.

Both men were taken to the police station in Philipsburg where they were processed and are being detained.

Chief Prosecutor Hans Mos declined to comment on the murder investigation and on why the one man was believed to be a suspect. Neither was information available about why the other man was arrested.

Police are currently working to solve a number of murders that happened this year. Of the 16 murder cases so far this year, police and Prosecutors have been able to officially close four.

Foundation opposes proposal for amusement park at Wilson Estate

PHILIPSBURG--Emilio Wilson Estate Foundation (EWEF) is again urging Government to pursue all legal and financial means necessary to realise its commitment to secure Emilio Wilson Estate as the island's first land-based protected area and National Park.

The foundation, in a press statement Tuesday, drew attention to a proposal from November 2010 to develop the estate into "Golden Rock Park," an amusement park for primarily (cruise ship) tourists, featuring zip-lining, chair-lifts to the top of the hill and rock climbing.

Having followed Rain Forests Adventure's "Golden Rock Park" proposal presentation, and having reviewed the documentation provided at that time, EWEF decided not to support the proposal for Emilio Wilson Estate.

The then-Island Council of St. Maarten first approved an Island Resolution aimed at protecting Emilio Wilson Estate on September 20, 2005, as a result of widespread public pressure to do so. From 2005 through 2008 government implemented a number of basic measures towards the protection of the estate, including placing the entire area on the monument list. However, the estate is still very much under threat of commercial and residential development.

According to EWEF, the Golden Rock Park proposal entails large scale construction of infrastructure and facilities on the hillside, top and ridges of Sentry Hill, as well as the alteration of the natural rock formation at the top of the hill. Plans include permanent structures above Sentry Hill's 200-metre altitude line.

St. Maarten's Hillside Policy was drafted "to conserve the green hillsides, protect and if needed restore their natural value for the benefit of the environment, the tourist industry and quality of life in St. Maarten." The Golden Rock Park proposals are in violation of the country's hillside policy, which states that "no building should occur on hilltops, ridges, and above the 200-metre altitude line."

The area above 200 metres is the most ecologically significant area of Sentry Hill/Emilio Wilson Estate. The proposed activities would have a permanent and undesirable impact on the flora and fauna of the area, both during and after construction.

EWEF also said the proposed project did not provide for educational activities regarding Emilio Wilson Estate's history and its importance as a unique aspect of St. Maarten's, the Dutch Kingdom's and the Caribbean's shared heritage. It is focused on the commercial, mass exploitation of Emilio Wilson Estate in the form of an amusement park, with no noteworthy conservation initiatives and no regard for the cultural significance of the area and the slaves who toiled on the estate for generations.

"Government has made commitments to the people of St. Maarten to protect the entire Emilio Wilson Estate, which is now officially a recognised national monument. The foundation is therefore surprised to have been informed that Minister Theo Heyliger is supporting Rain Forest Adventure's Golden Rock Park proposal and that the plan is now being reviewed by relevant government departments.

"It would set an unwanted precedent if government were to even consider supporting the Golden Rock Park proposal on Emilio Wilson Estate, which has been formally established as a National Monument and is clearly a part of the people's patrimony," stated EWEF in its press statement.

The foundation noted its own efforts to ensure protection of the estate, which include repeatedly petitioning Government to take measures to protect the estate and even purchase it. The foundation hired consultants to compile a business plan for Emilio Wilson Estate Ecological and Historical Centre and has applied to a number of Dutch and International funding agencies over the past six years for financing to purchase the estate.

"While the cultural and ecological value of the estate for St. Maarten, the Kingdom and the Caribbean is undeniable, the aforementioned applications have all failed, due to the absence of financial and legislative support from St. Maarten's Government for the protection of the island's heritage," said EWEF's press statement.

Emilio Wilson Estate Foundation (EWEF) was established in 2005 to give voice and structure to the overwhelming outcry of opposition amongst the population to plans for the development of a gated residential area on pristine and historic Emilio Wilson Estate. Its goal is to turn the estate into Emilio Wilson Estate Ecological and Historical Centre and Protected Area, much like Cura�ao's Christoffel Park, Aruba's Parke Arikok and Puerto Rico's many protected areas.

Ranil vows to carry on campaign to release Fonseka

Opposition Leader Ranil Wickremesinghe today vowed to carryon the campaign to secure the release of General Sarath Fonseka from jail.

Addressing a public campaign at the Hyde park corner Mr Wickremesinghe said that he would take up the issue with the Human Rights Council.

“We have been speaking about the issue of getting rid of this government, but now it is time to take to the streets and get into action”, he said.

He said in the next few weeks they will get to the villages to strengthen the party at village level to achieve the task of getting rid of  the UPFA government.

Mr. Wickremesinghe said that all ventures taken over by the recently passed Bill in Parliament will be returned to the owners when a UNP government is in power.

New identification cards for country St. Maarten launched

PHILIPSBURG--Prime Minister Sarah Wescot-Williams on Wednesday launched the new Identification Cards (IDs) for Country St. Maarten in the presence of Department of Civil Registry (Census Office) staffers and clients.

The Prime Minister unveiled an enlarged mock copy of the card and was presented with a copy. She also registered for her new ID card.

The new cards are blue in colour and feature an image of the national bird - the brown pelican - in the background. Shortly after Monday's launch, members of the public were able to register for the new cards, which will be available a day after registration.

The new card has double the number of security features as the previous cards and will go through several layers of verification and quality control before being issued to the public, Census Office head Leona Marlin-Romeo told The Daily Herald shortly after the launch.

Marlin-Romeo said there had been cases in the past where persons had tampered with and manipulated the features of the previous cards. She said while there weren't many of these cases, the security features in the new cards are an improvement.

The new cards are also of international standards and are capable of being scanned and read electronically by 3M machines.

The creation of the new cards was a group effort by the Department of Civil Registry and the company that produced the cards. There were several options and the one unveiled was selected.

Unlike the previous cards, the new ID cards can be issued to persons from birth, Marlin-Romeo said. Previously, cards were only issued to children 12 years and older. The same application procedure applies to all applicants.

The application fee for a new card currently stands at US $20, but the tariffs for the new cards will be adjusted in the future.

Commending the Department on the launch, Wescot-Williams said the process to introduce the new cards took a while, but she said the legal basis needed to be in place to facilitate the introduction. Efforts, she said, were not only made to upgrade the security features on the new card, but to also include some of St. Maarten's national symbols on it. "I look forward to many persons getting and proudly displaying their new ID cards," Wescot-Williams said adding "it could not have come at a better time as we celebrate St. Maarten's Day week."

Marlin-Romeo said it was with great pride that the cards were being launched. "We have obtained our new country status and with that in mind it is important that we have an ID card that reflects that we have a new status instead of having a card that states Netherlands Antilles.

"We are busy building a new country and it is important to identify ourselves with a card that represents the country that we are from."

To facilitate the issuing of the new ID card, two options have been made available for the public. The first option is walk-ins. Individuals may visit the Civil Registry Office from Monday to Friday between the hours of 8:00 and 10:00am.

The second option is by appointment, Mondays to Fridays from 11:00am to 3:00pm. Those wishing to make an appointment can call 542-2457. Wednesdays have been reserved for civil servants only for the months of November and December between the hours of 8:00am and 12:00noon.

Gendarmes seize cache of weapons, ammunition

MARIGOT--A raid carried out by Gendarmes at a house in French Quarter on Wednesday, November 16, turned up a stockpile of weapons and ammunition, disclosed the Gendarmerie Thursday.

Among the weapons discovered were a pump gun, 9mm handgun, an automatic weapon, rifle, a silencer, a bullet-proof vest and 520 rounds of ammunition. One person, suspected of being the owner of the weapons, was detained for questioning.

The Gendarmerie also revealed three persons have been arrested and transferred to Guadeloupe in connection with the two armed robbery attempts in Lowtown, Marigot, on June 11.

At the time, two individuals entered a Change Express and attempted to gain access to the cashier by shooting a bullet through the glass security door. After not being able to penetrate the security glass and enter the back office, the thieves left empty-handed and proceeded to rob the till money from a Chinese supermarket further down the road.

During the following weeks detectives identified one of the suspects, who was arrested and transferred to Guadeloupe. Then on Monday, November 21, an operation was mounted to arrest two more suspects in their respective homes in Sandy Ground.

The two individuals aged 21 and 22 years are now in detention in Guadeloupe awaiting trial.

Unions rally behind dismissed Simpson Bay Resort workers

~ 'Only the workers can save the workers,' says Elshot ~

PHILIPSBURG--The unions under the Windward Islands Chamber of Labour Unions (WICLU) have declared their solidarity with the more than 100 dismissed Simpson Bay Resort and Marina (former Pelican Resort) workers, who have been replaced by temporary workers.

The unions will also be requesting a meeting with Labour Minister Cornelius de Weever on the matter Windward Islands Teacher Union (WITU) President Claire Elshot told The Daily Herald on Tuesday. She said the unions are hoping to meet with the minister on Wednesday, December 7.

The unions declared their solidarity to protect the workers during a meeting at the WIFOL building on Saturday.

Attending that meeting were representatives of WITU, Workers Institute for Organised Labour (WIFOL) which represents the Simpson Bay Resort and Marina workers, St. Maarten Communications Union (SMCU), the Windward Islands Health Care Union (WIHCU) and the Association of Staff Employees of GEBE.

Windward Islands Civil Servants Union/Private Sector Union (WICSU/PSU) which has a newly-elected board of directors was not present at the meeting, but the relevant information will be forwarded to the new board.

"In general the Chamber is pledging solidarity in the case of the resort workers because you have to do what you have to do for the workers. To have temporary workers substituting for permanent workers is an enemy to any workers' organisation around the world. To send permanent workers home and have temporary workers in their place, whether on contract or not, is not acceptable," said Elshot.

"At the recent 100th session of the ILO in Geneva a convention was passed to protect domestic workers under the agenda decent work. And everyone in St. Maarten is entitled to decent work.

"As unions we have to defend workers. Sending home 100 people is a disaster. It has an enormous effect on them and their families socially, economically, morally and ethically. We are up for a disaster on this island. Do you really want to have a disaster in December?" Elshot asked rhetorically.

"It is our duty to defend these workers. It is only the workers who can save the workers, so the workers institutions are prepared and are being prepared and preparing our people," she said.

During Saturday's meeting the unions also decided that they will hold a press conference on November 29, to update the media. They will be meeting with Aruban trade unionist Anselmo Pontillus, who will be in St. Maarten for a mediator's conference in St. Maarten next week.

Kuwait cabinet submits resignation

Kuwaiti opposition lawmakers on Monday said the government has submitted its resignation amid a growing crisis over corruption accusations.

One opposition lawmaker, Khaled al-Sultan, told the AP that the Cabinet tendered the resignations hours before a major protest rally was set to start.

Earlier this month, opposition lawmakers and protesters stormed parliament to demand the resignation of Prime Minister Sheikh Nasser al-Mohammad al-Sabah. At least 45 people were detained over the incident.

The foundation hired consultants to compile a business plan for Emilio Wilson Estate Ecological and Historical Centre and has applied to a number of Dutch and International funding agencies over the past six years for financing to purchase the estate.

"While the cultural and ecological value of the estate for St. Maarten, the Kingdom and the Caribbean is undeniable, the aforementioned applications have all failed, due to the absence of financial and legislative support from St. Maarten's Government for the protection of the island's heritage," said EWEF's press statement.

Emilio Wilson Estate Foundation (EWEF) was established in 2005 to give voice and structure to the overwhelming outcry of opposition amongst the population to plans for the development of a gated residential area on pristine and historic Emilio Wilson Estate. Its goal is to turn the estate into Emilio Wilson Estate Ecological and Historical Centre and Protected Area, much like Cura�ao's Christoffel Park, Aruba's Parke Arikok and Puerto Rico's many protected areas.

Fired resort workers return to work on WIFOL?s advice

~ But being barred from functioning ~

PELICAN--The group of Simpson Bay Resort (former Pelican Resort) workers who were told by General Manager Jules James to go home last week Friday returned to work as normal from Saturday on advice of their union and its attorney.

However, the workers are being barred from executing their duties, Workers Institute for Organised Labour (WIFOL) President Theophilus Thompson said on Sunday.

Simpson Bay Resort Management Company General Manager James could not be reached for comment on Sunday. Calls to his mobile number went unanswered.

Thompson, who met with the workers on Saturday afternoon along with WIFOL's attorney, said the employees' punch-in cards had not been returned and the resort had hired workers from an employment agency to carry out the work of the staffers.

The union president expressed disappointment in James, a United People's (UP) party Member of Parliament (MP), who he said was blatantly violating St. Maarten's labour laws.

Thompson said James could not send home workers verbally, as he had attempted to do last week Friday. He said workers could be dismissed only in writing, with the reasons for their dismissal stated.

"It's a pity that he's a Member of Parliament and he doesn't know the labour laws. We have instructed the workers to show up as normal and they are doing that. And the company is not allowing them to work.

"Jules [James] has allowed casual workers to work in their place and the Labour Department should send labour inspectors to see who these workers are who are being sent to replace unionised workers," Thompson said. "I don't think Jules James is worthy to be a parliamentarian. It's a conflict of interest."

WIFOL explained during the meeting with the workers on Saturday what it called the court's "blunder" and the union's and attorneys' position on it. He said the workers "are being strong" so far and were confident that "we will have the court, which is a continuous process in this battle between management of the company trying to rid itself of its permanent staffers and wanting to replace them with casual workers.

"I hope that our government doesn't allow this to happen. The Parliamentarians should look at this and ensure that permanent employment is not jeopardised by a company wanting to have casual workers via employment agencies."

Thompson said the manner in which employment agencies were being used "is illegal" in St. Maarten and contrary to International Labour Organisation (ILO) conventions that he said had been ratified by the former Netherlands Antilles. "Employment agencies are for temporary workers and not to replace permanent workers," he stressed.

Thompson said the way employment agencies were being used in St. Maarten "is a disgrace to our legal system." He said WIFOL would make a report to the ILO about this matter, which he said would put St. Maarten in a bad light and was not something he wanted to see happen.

"What Jules James is doing is contrary to his function as an MP. He hasn't served anyone notice. He sent home those in the meeting. It's all intimidation tactics," Thompson said.

He said he wasn't aware whether any of the workers had signed a contract to work for the new owners of the resort, as they had been requested to do when sent home on Friday. He said WIFOL would request a meeting with the labour mediator, the Labour Department and Labour Minister Cornelius de Weever on this matter.

Non-violence Does Not Have to Be Passive

I have just watched the video of the University of California students at Davis against the heavily armed police that is becoming prominent on many internet sites and I am reminded, among others, of the non-violent responses of the Palestinians to their occupiers (see “Refusing to be Enemies - Palestinian and Israeli Nonviolent Resistance to the Israeli Occupation,”  Ithaca Pres, 2011).  The video shows clearly the actions of the police pepper spraying passive students sitting on the ground, heads down.  Following that, without any real organization of leadership, the students start slowly almost imperceptibly at first, moving forward toward the police.  The resolution is that the police finally turn and leave the site.  An earlier video, showing U.S. Marine Corps Sgt. Shamar Thomas shaming a squad of New York city police, serves as another excellent example of non-violence actively confronting threatened or implied violence. 

The highlight of this is that non-violence need not be passive.

Non-violence can be passive, and does at times necessitate full passivity in the face of impending violence.  But in other circumstances, especially where the overwhelming balance of force is on one side, a pro-active non violence can be very effective.  The police/military are then forced into a decision: to either use violence against the protesters; or to stand down from the protesters. 

Included in this is the nature of social media and the ubiquitous presence of cameras, videos, cell phones, and their immediate input into the airwaves of the world.  If the police are to choose violence, that will be seen globally, even if the mainstream corporate media do not pick up on it.  If the police choose to stand down, that also will not be seen in corporate media. But everyone else will see it nevertheless.  

Historically, pacifism did not bring about significant changes to the social structures and politics of the world.  The Magna Carta (1215) in England was not donated willingly by the King but forced upon him by his rebellious barons. Interestingly enough, this was not a rebellion to replace one monarch with another, but to limit the powers of the absolute monarchy.  The unions that workers attempted to form were not aided and abetted by the corporations that were involved.  Union development in the western world is the story of workers’ rights and better working conditions up against the forces used by the corporate elites, the  militaries and hired police.  Many workers’ strikes were settled by violence before unions began to have some recognition under law, unfortunately later many of them were co-opted by the union bosses to support one political position or another of the elites. 

The women’s suffragette movement was not a peaceful one, and involved violence against the women, with the women resorting to hunger strikes and chaining themselves to barricades in order to pronounce their determination.   World War I had a significant role in giving women the right to vote as they ‘demonstrated’ their abilities to replace men in the homeland manufacturing centres.  The freeing of the black slaves in the U.S. and then the long struggle to have equality in society was not given to the black people voluntarily.  It involved a long history of violence against blacks and their supporters.  This violence continues today with the inequalities of race and crime based on this historical pattern. 

Ghandi spoke of non-violence, but was not passive in his opposition to the British empire in India.  Martin Luther King spoke of non-violence but was not passive in his actions against racial discrimination in the U.S.  The Egyptians demonstrated non-violence in Tahrir Square and are still under fire from the military regime now controlling Egypt (and why not, for all the billions of dollars they receive from the U.S.?)  The Palestinians practice non-violence on a daily basis, protesting against the illegal “wall” that is expropriating their territory, and in a large part by simply existing and being, proceeding with life trying to give it some sort of semblance of civility under occupation.  Protesters in Bahrain and Yemen who have been non-violent have had overwhelming force used against them - as did the Indians, the blacks, the Egyptians, and all others who have protested non-violently. 

So there is an obvious downside to protests and struggles for human rights, but that is part of what non-violence is about - a clear demonstration that the powers that be are not democratic and are in reality against the masses of the people (except as consumers and cannon fodder of course).  The elites are not aligned with the people, are not accepting their own rhetorical standards of free speech and democracy, and with other elites will do their best to control the voice of the people.  It is an alignment of the contradictions of society where those in power clearly do not lead the people, where the elites are clearly in opposition to the people, and in some cases will go to great lengths, including torture and murder, to keep their positions.

Occupy Wall Street for the moment remains a relatively calm demonstration, with non-violence  being one of its hall-marks (the other main one being that it is essentially leaderless).   The elites will look for weaknesses and try to exploit them.  The elites main weapon for now is the overall tenor of fear that they present to society: fear of communism, fear of terrorism, fear of crime; all embellished by the corporate media to both entertain and contain the thoughts of the hopefully ignorant masses. 

The lessons learned from the efforts of the Palestinians can be incorporated into the occupy movement.  What the state [of Israel, the U.S. ….] fears most of all is the hope that people can live together based on justice and equality for all. Non-violence becomes a pro-active dynamic, with actions taken that are similar in nature to civil disobedience (in cultures where there is civil law, rather than military rule).   Another aspect is that of normalization - the elites want a leader, they want to negotiate, they want to buy off the leaders (or imprison and decapitate them to instil fear).  Non-violence disallows normal relations, the goal is to replace the subservient position with one of equality in all areas.  In other words, through non-violent resistance, the [Palestinians, Occupy movement….] are not accepting the status quo, are not accepting that the media will be able to present a picture that life continues as normal within the elites’ mode of controlling society. 

Non-violent protest can lead to very violent counter-actions. If that happens to the Occupy movement, it will be seen around the world, and the world, once again, will see that what the U.S. claims about freedom and human rights is simply rhetorical fodder to cover up their real interests in power and control of people and resources.   If nothing else, the Occupy idea is out - corporate wealth is creating great inequalities within the U.S. (…and Canada, and Mexico, and Europe, and any other nation that supports the globalization of capital and the governance of corporations over sovereign nations).  

Ideas cannot be removed once put out.  Non-violence is the best way to maintain the message and keep the pressure on in an otherwise violent - threatened or applied - system.

Maho comptroller arrested for fraud

MAHO--Long-serving Sonesta Maho Resort and Casino comptroller D.M. was arrested last Friday on suspicion of embezzling large sums of money from the resort for which he has worked for more than a decade. Investigators are conducting a "fact check" of the case.

A Canadian residing on the island, D.M. held a management-level position and was responsible for supervising the quality of accounting and financial reporting of the resort. He is suspected of stealing a considerable amount of money from the resort. The exact amount was not made known, but is believed to be more than US $100,000.

Authorities were alerted to D.M.'s alleged fraudulent activities and his plans to leave the country were thwarted when he was arrested last Friday. Chief Prosecutor Hans Mos said that if the suspect had been able to leave the island finding him would have been very difficult.

Resort management first learned of D.M.'s alleged embezzlement scheme through an audit done by an independent accounting agency. The report showed several discrepancies that gave cause for further investigation.

Mos explained that the objective of the current investigation was to search for the embezzled funds and compensate the resort for its losses. Investigators believe D.M.'s money is saved in Canada.

The Prosecutor's Office may begin a criminal case against the suspect after the fact-finding is completed. Because of the nature of the crime, it may be possible for D.M. to pay a fine rather than serve a prison sentence. The estimate of how much D.M. may have to pay in fines is negotiable.

Contacted for comment on the case Tuesday, Sonesta Maho management maintained that D.M. simply was no longer employed by the resort, but would not confirm that a criminal investigation was in progress.

CFT team arrives for budget consultations

PHILIPSBURG--A team from the Committee for Financial Supervision CFT is in the country this week to continue their review of the draft 2012 budget. They are slated to have meetings with Secretary-General of Finance Sherry Hazel and ministry staffers.

CFT reportedly has some questions about the build-up of government's additional income as projected in the draft budget. Talks are expected to centre on this matter.

Finance Minister Hiro Shigemoto confirmed that the CFT officials will be on a working visit to the country. He said the Council of Ministers is set to approve a summary of the draft budget today, Tuesday.

Shigemoto declined to go further into the agenda for the consultations, saying that these are still technical discussions, as the review outlined in the Kingdom Law on Temporary Financial Supervision for Cura�ao and St. Maarten is still ongoing.

The Council of Ministers approved the draft balanced budget, which stands at NAf 432,549,600, NAf. 11,633,003 million more than this year's budget of NAf.420,916,597 million, on Tuesday, October 18. This was followed by the immediate preparations to send it to the CFT.

When the budget is returned with a positive from the CFT, it has to undergo one more check by the Advisory Council before it is forwarded to Parliament by the governing coalition via the Cabinet of the Governor.

Parliament needs to debate and approve the budget before the end of December to be in compliance with the Kingdom Law on Temporary Financial Supervision for Cura�ao and St. Maarten.

Transhipment slightly increases after fallout

POINTE BLANCHE--After almost flat-lining last year due to the global economic crisis transhipment from St. Maarten, a major feeder port for the north-eastern Caribbean, saw some signs of recovery in October with a 20 per cent increase in transhipment cargo compared to the same month last year.

St. Maarten Harbour Group of Companies CEO Mark Mingo is hopeful about the growth in the transhipment business particularly with some large projects in the pipeline. He pointed to the planned development of Scrub Island, Anguilla as a potential to drum up business because cargo would have to come through St. Maarten.

While transhipment is increasing, so are cargo imports in general, explained Mingo. This increase is spurred on by local consumption, stay-over and cruise tourism industry demands. Mingo sees this as "a positive, but cautious outlook for imports."

The harbour group, like others in the region, is gearing up for the opening of the expanded Panama Canal in 2014 and the far-reaching changes this will bring to the feeder ports like St. Maarten from that cargo will be distributed to surrounding islands.

St. Maarten is in a good geographical position to capture opportunities from the Panama Canal with the right cranes and stevedoring services, as well as the fast movement of containers in and out of the port with the Global Logistics System (GLS); this system decreases delays and provides real time invoicing to clients.

The investments made into the cargo facilities and other upgrades will serve the harbour well as it is poised for a "huge role as a feeder port," Mingo said.

Commenting about plans to have the Customs Department receive copies of the bill of lading for containers, as announced by the Minister of Economic Affairs Franklin Meyers, Mingo said while new policies are needed in the long run there is greater need for communication.

"The harbour is a facilitator for the increase the economic activities for the island, as is the Princess Juliana International Airport; this fact makes it imperative for all change to be timely and properly discussed with the two ports of entry to avoid hampering business," Mingo said, "We need to work together."

He pointed to the issues faced by St. Thomas as a transhipment hub when the United States government implemented new security measures for cargo that cost shippers time and money.

At least 19 dead in Iraq prison attack

A suicide bomber slammed a car packed with explosives into the gate of a prison north of Baghdad on Monday, killing at least 19 people, Iraqi officials said. The blast took place in the town of Taji, some 20 kms north of the capital.

Death toll rises to 20

The death toll from the stormy weather conditions rose to 20 by Monday morning while 20 fishermen are reported missing, Disaster Management Centre (DMC) announced.

Last week’s gale-force storm and heavy showers have affected 66286 people of 16837 families.� According to the DMC, 737 houses have been fully damaged while 6400 partially.


The worst affected�were the coastal areas of Galle and Matara where 17 people were confirmed dead by Friday.� Floods were also reported from the Northern, Eastern, Southern and North Central Provinces. In Monaragala, Anuradhapura and Batticaloa districts overflowing water reservoirs have forced the irrigation authorities to open sluice gates.

St. Maarten/St. Martin Day has memorable observance

page5f151PHILIPSBURG--Feedback from participants in the wide range of activities in conjunction with St. Maarten/St. Martin Day indicates a successful effort on part of the St. Maarten/Martin Day Organising Committee.

Much was expected from yesterday as the first observance of St. Maarten/St. Martin Day under St. Maarten's new country status. Philipsburg saw an influx of red, white or blue T-shirts or a combination of all three colours as individuals demonstrated their patriotism to their country.

With official business of the day off the agenda by lunchtime the Festival Village was abuzz as patrons were entertained by a line-up of local acts and enjoyed the variety of refreshments.

The Dance Theatre of St. Maarten choreographed a cultural manifestation that saw the various nationalities on the island represented by dancers dressed in traditional wear and opened with fireworks. As one group plaited colourful ribbons around a pole in the traditional pole dance, the others surrounded them with St. Maarten/St. Martin flags in hand.

This spectacle attracted attention to the centre of the Festival Village, which had been cleared to accommodate the performance. Performances by Tanny and the Boys, the Jolly Boys and Gunslingers followed.

The afternoon's cultural parade attracted even more crowds. Both sides of Walter Nisbeth Road were occupied by individuals having a look at the cultural attire and practices of those amongst whom they live. Some related the day to Grand Parade Day during Carnival, when the Festival Village is the busiest.

Various nationalities such as Filipino, Dominican Republic and Guadeloupe, amongst others, were represented in the parade. Several businesses and service groups as well represented their products in the parade.

Following the parade the crowd continued into the Festival Village for some more entertainment, including Freedom Fighters featuring Nah-Jah and Ku-J, Ruphy and Pure, Dread I, the Mighty Dow and others.

Petite Committee to deal with GEBE and Winair

THE HAGUE--The establishment of a Petite Committee of Experts from the Netherlands and St. Maarten has been proposed to deal with open issues such as utilities company GEBE and Windward Islands Airways Winair, in which St. Maarten and the Dutch public entities of Saba and St. Eustatius have shares.

Finance Minister Hiro Shigemoto, who met with Dutch State Secretary of Finance Frans Weekers on Wednesday to discuss these and other matters, said this is one of the positive outcomes so far of his working visit. Weekers also believes that these open issues must be looked at from a broader perspective.

Shigemoto said, "We have a number of issues dealing with our sister islands that includes taxes, GEBE and Winair to name a few. St. Maarten consumers have been subsidising the electricity supply for years. The two air routes to Saba and St. Eustatius also deliver losses.

"We understand that an air-link between the islands is part and parcel of the socio-economic development of the islands, and therefore the proposed establishment of this petite committee is a very positive and significant development in resolving these issues after the dissolution of the former Netherlands Antilles."

As for GEBE he said, "The people of St. Maarten are demanding relief and we are working diligently to bring this relief by resolving issues left undone."

Once the Petite Committee of Experts presents its findings, the two governments will meet to take the political decisions.

Dealing with the levying of Turnover Tax (ToT) for goods going to Saba and St. Eustatius from St. Maarten, Shigemoto explained to Weekers that St. Maarten is in the process of developing a new tax system that should be ready by 2013, which includes revamping and redesigning of the ToT.

"For St. Maarten to be able to offer any relief before that time would be extremely difficult as we have to contend with the rules and regulations of the Committee of Financial Supervision CFT, as well as the presentation of lean balanced national budgets for 2011 and 2012, which covers the operational expenses of Government," said the finance minister.

The government of St. Maarten cannot afford to miss any income that would result in a deficit which goes against the financial supervision rules and regulations, he said.

The finalisation of the buying out of the nine per cent in the Central Bank of Cura�ao and St. Maarten owned by Bonaire, St. Eustatius and Saba was another area discussed by the Minister and Secretary of State.
