Open Letter to Congress: Study War Some More

Dear 112th Congress:

You are surely as inspired by events in Cairo, Tunis, and Benghazi as the rest of us. And you are surely as distressed by events in Afghanistan, Iraq, and Pakistan as your fellow Americans. Now is as good a time as any to face a grim fact: you and your recent predecessors are abject failures at one of your most important constitutional responsibilities--dealing with war. But you can still redeem yourselves, and do your constituents and your country a historic good turn in the meantime.

The Constitution requires you to declare, provide for, budget, and oversee war and the forces necessary for it. There are few if any analysts who believe you ably perform these duties. Instead, with the exception of funding, you’ve ceded much of this authority to a succession of presidents from both parties only too eager to supplant you. And with war funding, Congress has been little more than a bipartisan rubber stamp for presidents. To make matters even worse, Congress “pays” for war with money borrowed from foreigners and from future generations of American taxpayers. War spending is not an “investment in the future” like your allocations for scientific research or green energy development. Congress would’ve provided a greater public service had it taken the trillion borrowed dollars wasted in Iraq and Afghanistan and started a giant bonfire with the money on the National Mall.

Your best attempt to rein in presidential war making—the War Powers Act—did not restore your authority or pride, and did not prevent your grievous mistakes after 9/11. With the exception of the one-time need for “authorizations of force,” and enormous semi-annual infusions of men, money, and materiel, presidents prefer to leave Congress out of the war equation.

Contrary to the refrain of the iconic African-American spiritual—it makes sense for legislators responsible for it to study war. Studies of the wars in Afghanistan and Iraq, and of US military omnipresence around the world, constitute an invaluable and growing library. The studies, from a wide swath of think tanks and academic researchers across the political spectrum, show, virtually without exception, that it’d be much smarter and cheaper for Congress to end the wars and the omnipresence. Peace and a reduced global American military footprint would be diplomatically and politically, economically and culturally better for the country. Ending the wars would save American lives and those of other peoples. Closing bases overseas, and returning those forces to the US, will have the same local and regional economic benefits in those places that we’ve seen from conversion at home.

Neither of the current wars is or was necessary. There were and are alternatives. Nearing retirement, this is now the view of Defense Secretary Robert Gates too. Neither of the wars can be presently shown to do anything but harm to US national security.  Both ramped up—not reduced--the terrorist danger to America. Think about it: where’s the upside to ten years of war in Afghanistan (besides to war profiteers)? It reduces the jihadi threat to the Homeland? We’re fighting them over there so we don’t have to fight them over here? You’re kidding, right?

The Obama administration admits that al-Qaeda’s presence in Afghanistan is negligible. It also admits that war in Afghanistan inflames the border provinces of the neighbor to the east—if not the whole of Pakistan. It’s past time to declare victory in Afghanistan and bring all fighting forces home. If the war was about ending safe havens for terrorists in Afghanistan, then it’s succeeded. If it was about removing the Taliban regime, then it’s succeeded. If it was about showing American resolve and fortitude, then it’s worked. If it was about vengeance for 9/11, then it’s worked. If it was about helping deform Pakistani politics, then it’s worked. If it’s about making Afghanistan safe for Chinese and Indian enterprise, then it’s worked. If it was about stimulating the opium trade, then it’s worked. Etc. Remind me: why are we still there? Rather than afraid of ‘losing Afghanistan,’ President Obama appears afraid of winning.

The bloody road to freedom in the Middle East will likely lead to the demise of al-Qaeda. Much of the draw of al-Qaeda’s brand of jihad will disappear if and when popular rule comes to the lands from which it recruits. Why sneak away from your hometown to join al-Qaeda in the Mahgreb if you now have real prospects for meaningful political participation? As political and economic opportunity grows in the region, al-Qaeda’s allure for the young and alienated will shrink. As American troops come home from Iraq, a large chunk of al-Qaeda in Mesopotamia’s reason for being evaporates. We’ll see the same trend in Afghanistan. Why let some fast-talking mullah lure you into the Taliban if you have educational and commercial alternatives, and the Americans are gone?

Remaining American forces in Iraq should be withdrawn on schedule, regardless of pressure from the Pentagon. No serious threat to the United States or its allies emanates today from Iraq. Rather than extend the US combat presence in Afghanistan to 2014 or beyond, as the current plan appears to (likely unbeknownst to you) Congress should help the President and Vice President deliver on their promise to begin withdrawal of US troops this summer.  Any additional funds you provide for the war beyond this fiscal year should be limited to ensuring the safe and orderly redeployment home of all American combat forces.

I understand this is not easy for you. You are mostly not military or foreign policy experts yourselves. There is no irresistible pressure on you from the peace movement in your district or state at present to end the wars. Many of you have defense industries or military facilities in your districts or states. Many of you fear being targeted by pro-war lobbies, presidents, or challengers. There has, thus far, been little or no political cost for you to say yes to the wars and their gargantuan human and economic costs.

There is no easy solution to the dilemma. It’s far easier to say “end the wars through the power of the purse” than it is to do it. In the final analysis, however, and as in Southeast Asia in the early 1970s, that’s how American participation in these wars will end. Your colleagues then said ‘enough is enough,’ and refused to appropriate further monies. Presidents appear incapable of taking such steps themselves, and for some of the same reasons. 

Will it require uncommon valor to snap the war purse shut? Yes. Will you be vilified by that very small number of us who benefit from the wars? Yes. Will you demonstrate rare independence from a President on questions of war and peace? Yes. Will you, most importantly, be forever esteemed by veterans, parents and families of deployed service personnel, a growing majority of your constituents and other taxpayers? Yes.

Police investigate assault on guard

SIMPSON BAY--A security guard from a well-known security company was working in the Simpson Bay area last week when he had occasion to stop and check a person who was entering the building. The man was in plain clothes and showed no indication that he was in fact "special."

After a quick check it was established that the man was allowed into the building to collect his child from some class that had been taking place. The man collected his child and took the child to his car. He then returned to the security guard and told him to remember his face. He was quite threatening and took offence at being questioned as to his purpose and authority to enter the premises.

The guard was charged with ensuring that only parents and persons with the credentials to do so entered the building, for the safety of the children, one of whom was his.

A couple of days later the guard was again at his place of work when four persons, one a woman, approached him. All four were wearing police uniforms and they reportedly punched the guard in the stomach, bundled him into a car and gave him some rough treatment. As he was being released the child's father told him, "You will remember my face now, won't you?"

When asked about the incident police spokesman Inspector Ricardo Henson neither confirmed nor denied the details of the story on Friday. He told The Daily Herald: "An investigation is currently underway by the Internal Affairs Department and I can say nothing more about the matter at this stage."

The owner of the security company, who did not want to be identified, said, "I am very sad that this information got out. I have spoken to the police and as far as I am concerned this should stay as an internal matter for the police to deal with. There is too much negative news at this time and I believe that the police will deal with this issue in the proper way. I have not gone to the Prosecutor's Office with this matter because I have faith that the police themselves will deal with the situation."

US moving forces near Libya as "all options possible"

The Pentagon said on Monday it is moving some armed forces in the region near Libya in case they are needed.

Defense Department spokesman Col. Dave Lapan stated Pentagon planners are working on various options and contingency plans as the violence aimed at toppling the regime continues. Lapan told reporters Monday that as part of that planning, the Pentagon is repositioning some naval and air forces.

The U.S. has a regular military presence in the Mediterranean Sea.

Two home invasions reported Friday

PHILIPSBURG--A man entered a home on Pumpkin Road, Reward, at 9:50am Friday, February 11, and confronted the woman living there.

When the occupant heard noises from downstairs and went to see who it was, the robber ran up the stairs and threatened her with a handgun. He then proceeded to steal several pieces of jewellery, a laptop computer, credit and debit cards, and other personal items.

No one was injured during the incident, but the woman involved was shocked by the event. The robber fled the scene with his loot.

An elderly woman and her caretaker were robbed in their home on Marigot Hill Road, St. Peters, at 1:30pm Friday, February 11. They struck the robber several times with a walking cane, but he still managed to escape with a gold chain and pendant belonging to the owner of the home.

In both cases the robber was armed with a handgun and wearing dark clothing and a black ski mask.

The Special Robbery Unit and the Forensic Department are investigating both cases.

St. Maarten loses American Eagle San Juan flight in April to St. Kitts

AIRPORT--American Eagle is 1discontinuing all services between San Juan, Puerto Rico and St. Maarten effective April 5. American Eagle has been indicating for more than a year that stopping of the service was a real possibility if no financial support to maintain the flight was forthcoming from government.

While service to St. Maarten will stop, St. Kitts will be the beneficiary as of April.

The St. Kitts and Nevis Ministry of Tourism & International Transport this week announced a new and more extensive schedule for American Eagle service to St. Kitts and Nevis, following meetings between Senator Ricky Skerritt, Minister of Tourism and International Transport for St. Kitts and Nevis and President and CEO of American Eagle for Florida, the Bahamas and the Caribbean Pedro Fabregas.

The April 2011 schedule will feature daily service between San Juan and St. Kitts and add a Friday/Saturday, Saturday/Sunday late evening incoming and early morning outgoing service, the timing of which will facilitate important connections in San Juan, as well as a weekly Saturday day trip service to Puerto Rico from St. Kitts. Nevis will get three non-stop flights per week from San Juan.

Currently, American Eagle flies from St. Maarten to San Juan one time a day, down from five times a day at one point. Minister of Tourism Franklin Meyers, last week, stated he would meet with American Airlines executives this month after learning that the airline might reduce the number of its Eagle flights to and from San Juan, Puerto Rico, to three times weekly.

According to the Minister, American was willing to re-consider if government financially supports the airline to the tune of US $8,266 a week, which amounts to US $429,832 annually for St. Maarten. Sources inside American on Friday said they got the impression that St. Maarten, since early 2010, did not take the situation seriously enough to address them post haste.

The news comes on the heels of reports that St. Maarten will lose the GOL flight as of March 2011. Government was to make attempts to save that flight as well, but no information is readily available as to the outcome of those efforts.

When American Airlines discontinues its service, it will leave St. Maarten with only InselAir directly servicing San Juan twice a week. JetBlue had also indicated that it might be interested in the San Juan route from St. Maarten, but certain agreements with government would have to be in place before any agreement could be reached.

The bad news for St. Maarten has St. Kitts officials ecstatic. "I am particularly gratified by the outcome of our meetings, which has increased the existing American Eagle service to our twin-island destination and also provides new same-day weekend connections from St. Kitts to Los Angeles, Dallas/Fort Worth and Chicago with comfortable connections to American Airlines and other important carriers," commented Senator Skerritt.

"At a time when economic factors have forced American Eagle to roll back its presence in our region, I am very grateful for the positive consideration given to my requests by President Pedro Fabregas, who truly understands the importance of travel and tourism to the Eastern Caribbean."

"I have to commend Minister Skerritt on the determination and intensity he brings to the negotiating table," said Fabregas. "When we first sat down, the new April schedule consisted of only four flights to St. Kitts, with service to Nevis not even on the table. We finished with daily flights to St. Kitts, three times weekly non-stop flights to Nevis and additional weekend service to St. Kitts. We are doing all we can to facilitate our Nevis customers, but we have had to be pragmatic and use St. Kitts as the main airport for both islands. We have now what I consider a win-win agreement for both the airline and St. Kitts & Nevis," he concluded.

Minister Meyers could not be reached for comment on Friday. Country Manager of American Airlines Bennet Bell confirmed the discontinuation of the service but could not offer any further comment. St. Maarten is expected to still engage American Airlines to determine if the flight could be saved.

Tunisia lost 4 percent of GDP during revolt

The losses incurred by the Tunisian economy during the "Jasmine Revolution" are estimated at TD5 billion (US$3.52 billion), equivalent to 4 percent of the gross domestic product (GDP). This was disclosed Tuesday by Tunisia's Minister of Regional Development and Local Communities, Ahmed Chebbi.

Chebbi was quoted as saying: "preliminary estimate of losses is put at TD3 billion (US$2.11 billion), but there are medium and long term effects. We can estimate the total amount at TD5 billion, equivalent to almost 4 percent of the gross domestic product."

They gathered in the General Assembly Chamber of Parliament where they received information from Arrindell. They also asked questions and enthusiastically listed the names of members of parliament. The class visit was organised by the school as part of its leadership month programme.

Workers reject proposal, want retroactive payment by March 1

PHILIPSBURG--Government's latest proposal to pay its employees their additional 3.3 per cent cost of living adjustment by July 1 was unanimously rejected by workers during a "heated" meeting with their unions on Monday.

The workers said they were willing to accept the payment by March 1, but stressed that it must be retroactive to January. This was included in a proposal signed jointly by the Windward Islands Teachers Union (WITU), ABVO union and the Windward Islands Civil Servants Union/Private Sector Union (WICS/PSU) and forwarded to government yesterday.

The workers will be continuing their meetings today, Tuesday. Their unions have strongly condemned union busting tactics and threats reported by some of their members to deter them from attending the meetings. The unions said a senior official at the Labour Ministry was the main person threatening workers with dismissal if they did not show up to work (see related story).

In the proposal sent to government, the workers said the payment must be made to all civil servants and teachers, including teachers of the government subsidized school boards as well as police and coastguard staff. Government's failure to make the retroactive payment by March 1 will result in workers receiving "legal interest" on their owed cost of living adjustment for 2006, 2007 and 2009 and "a penalty fee of NAf. 250 to each [worker]."

The workers said they will continue their deliberations until a commitment has been given by government to pay the total balance of the 3.3 per cent.

"The unions will not accept any reprisal to their members for coming to the meetings held during working hours as it was Government that disregarded the decision of August 25,

2010, BC240810 agenda point 23 to pay all civil servants, teachers including teachers of the

subsidized school boards (police and coast guard staff) on January 1, 201l," it was stated in the letter.

Meeting

The large group of workers hammered out the details of the letter during a sometimes intense meeting with their unions at the L.B. Scot Sports Auditorium on Monday. At one point the auditorium had been packed to capacity with workers. The civil servants and teachers were joined by Pelican workers who had earlier met with their union Workers Institute for Organised Labour at the WIFOL building.

At one point a number of prison staff, including prison guards also joined the meeting, but subsequently left after the main points had been discussed. The workers seemed resolute to get a commitment from government for their full payment.

Elshot told reporters that some of the workers, including St. Maarten Academy teachers have still not been paid their January salaries.

Heyliger breaks ground for Middle Region upgrading

Page1B232MIDDLE REGION--Minister of Infrastructure Theo Heyliger broke ground on the infrastructure and water tank project in Middle Region yesterday, continuing his assurances that every district of St. Maarten would receive the necessary upgrades over the next few years.

"The project is not an easy one," Heyliger said. "But we've been moving ahead in the various districts with upgrading. While St. Maarten as a new country is going through some growing pains, in the next four years you will be seeing similar projects for the benefit of our people."

President of the Middle Region and Defiance Community Council Lenny Priest added that the project is an "extremely good one" for Middle Region and stressed that the residents also have a responsibility to maintain the areas once upgraded. He also lauded the fact that young men and heavy equipment of Middle Region will be involved in the project.

The 4.8 million-euro project provides for a proper waste water collection system, road resurfacing, sidewalk construction, sewage lines and street lights, as well as a water tank for GEBE.

Government has held talks with stakeholders, such as the utility companies (TelEm, Cable TV, UTS and GEBE) to put all overhead cables underground. With most of the financing being derived from European funding, government will cover the cost of upgrading the side roads in Middle Region.

The project will be executed in two phases, with the first phase getting underway on March 14. The entire project will be completed in June 2012. The work will start at the entrance of Middle Region, coming from Madame Estate.

Gaddafi speaks in front of his supporters in Tripoli

Libyan leader Muammar Gaddafi, on Friday made a surprising appearance in Tripoli's Green Square, speaking to a crowd of his supporters.

"We can defeat any aggression if necessary and arm the people," Gaddafi said, in footage that was aired on Libyan state television on Friday. "You, the youth, be comfortable? dance, sing, stay up all night," he said.

On Thursday evening, he made some comments by phone, leading to speculation about his physical condition. The footage aired on Friday, however, showed the leader standing above the square, waving his fist as he spoke.

They stressed that it was "out of the question" for Syrian troops on the Lebanese border to violate Lebanon's sovereignty, and said that if Damascus were to try anything foolish it would face a "strong international coalition" arrayed against it. "What world are they living in? Either they're joking or they're truly crazy," Boillon thought to himself at the time. Boillon accused� March 14th of living in a fantasy world fueled by a rumor-mongering Lebanese press, much of which is sympathetic to the Lebanese opposition. "Of course the opposition is going to claim that France is backing them, that's part of the game," said Boillon, who insisted that the March 14th leadership should be smart enough not to believe such tripe. But the reality, he lamented, is that March 14th is part and parcel of a political culture mired in navel-gazing and paranoia.Signs of Syrian Progress?-------------------------�4. (S) On a more positive note, Boillon recounted several encouraging signs with respect to Syrian�� behavior. First he said that the French have received "proof," in the form of assurances from the Qataris that the French have no reason to question, that captured Israeli soldier Gilad Shalit received a letter entrusted by his father to President Sarkozy, and that the Emir of Qatar later conveyed to Hamas politburo chief Khalid Mishal. Army nets in 5280 deserters

Some 5280 soldiers and officers have been arrested by the authorities since the crack down on army deserters since November one to date, a senior official said yesterday.

Military spokesperson- Major General Ubaya Medawala said that among those arrested were 12 officers from different regiments.

He added that those rounded up are currently being questioned to ascertain if they were involved in criminal activity during their time out with the army.

SHTA: ToT adjustment still not clear, correction not published

PHILIPSBURG--The St. Maarten Hospitality and Trade Association (SHTA) said over the weekend that the Inspectorate of Taxes had created more confusion with its "attempted clarification" on the changes in the turnover tax (ToT) ordinance and called on Minister of Finance Hiro Shigemoto to have the changes published as he had said he would.

The SHTA said it "understands that the Inspectorate of Taxes has sent out brochures" in which it attempts to give clarification" and also has learnt that the Inspectorate has tried to clarify the SHTA's interpretation of the law.

The SHTA said the brochures from the Inspectorate stated the following:

"Q. According to the SHTA, the new Article 5 implies that imported goods are now subject to ToT, establishing a five per cent import duty for resident companies, resulting in an additional layer of taxation. Is this true? No. The new Article 5, section 3 only states that non-resident entrepreneurs that deliver goods and provide services to resident buyers are deemed to be domiciled at the Inspectorate of the Tax Department.

"This is to ensure that non-resident entrepreneurs, when they are subjected to the ToT, are known to and registered at the Tax Department. This doesn't mean that the scope of the ToT, which is governed in Article 2, has changed. Article 2, section b clearly states that only when non-resident entrepreneurs deliver goods and/or provide services to resident buyers within the jurisdiction of St. Maarten, they are subject to ToT.

"When goods are imported, the delivery (transport) takes place outside the jurisdiction of St. Maarten and is therefore not taxed. In conclusion, ToT is not imposed on import of goods."

According to the SHTA, the explanation provided by the Inspectorate is incorrect and therefore has created even more confusion with no correction published, as the Minister "promised" in a press statement on January 10.

At that time the Minister said: "There is indeed an omission in the ordinance, but that will be solved via what is known as a 'reparatiewet' or corrective law. Even if this reparatiewet was not done, which it will be done, even in such a situation the current law would not have led to the undesired situation as presented by the SHTA in its explanation in a letter to the ombudsman."

Furthermore, the SHTA believes the additional expense for the entire system ? not just businesses, but the Inspectorate and Receiver as well ? could have been avoided by not implementing a tax change in the middle of a month. The additional work for the Tax Inspectorate and businesses is not just poor planning, but wasteful of limited resources.

"The SHTA is hereby requesting that the corrections be made and published on government's official Website

www.sintmaartengov.org and is calling on the Ministry of Finance or the Inspectorate of Taxes to organise or facilitate the organisation of an informative session for the business community to clear up the confusion regarding the ToT adjustment," the SHTA concluded.

PTA says Rhoda playing with children?s education

~ Furious over planned school closure ~

CUL DE SAC--Sr. Magda School's Parent Teachers Association (PTA) says Education Minister Rhoda Arrindell is "playing with the education and future of children" by authorising the closure of elementary schools for two days.

"It is mindboggling to read your letter, as we just lost four school days due to the industrial action of the teachers to secure their rightful cost of living payment. Your harsh "no work no pay" stance cannot rhyme with your subsequent letter of yesterday, closing down all elementary schools for two whole days," the PTA said in a letter to Minister Arrindell on Thursday.

The PTA said it was in "complete shock and dismay" to be informed of a letter from the Minister, dated February 9, "informing all school board members of an upcoming two-day closure of all elementary schools.

"You have granted permission to close all elementary schools on February 17 and 18 to accommodate the teachers to participate in the ASCD [Association for Supervision and Curriculum Development] annual conference.

"Let us remind you that this school year alone, all civil servants (including all teachers) already received three extra and unscheduled days off, namely: October 11, November 12 and January 3. On top of that there was no school for five days due to the passing of Hurricane Earl. Add to that the four days of strike and your planned two days next week and this results in a loss of classes of 14 full days (almost three whole weeks of classes)," the PTA said.

"The PTA of Sister Magda Primary School sincerely believes that you, as our Minister of Education, are playing with the education and the future of our children. The students who are in the sixth grade (group 8) already have to do their secondary school entry exams one month earlier than last year. Taking away almost another month of classes and preparation time puts them in a severely disadvantaged position.

"We certainly expect differently from you as Minister and strongly urge you to reconsider your letter and planned school closure," the PTA said. "We are absolutely in favour of upgrading and training our teachers, but urge you to schedule these events outside school hours to prevent any further damage to an already very disrupted and disturbed school year."

The Association said since its last letter concerning another possible school closure to accommodate the Census 2011 "went completely unacknowledged" by the minister's office, it decided to send its latest letter to her simultaneously to both newspapers in St. Maarten, "hoping to receive a swift reaction or response" from her this time.

Motorcyclist enthusiast dies in head-on collision

page3c232PHILIPSBURG--A well-known local motorcycle enthusiast was killed in a head-on collision on W.G. Buncamper Road near Caribbean Liquors and Tobacco around 1:00am Thursday.

The fatally injured man has been identified as Jean Claude Benjamin, a 39-year-old car and motorcycle mechanic.

He was very well known as a motorbike racer and the Suzuki GSX R1000 motorbike that he was riding was a high-tech speed machine that is faster than the fastest Porsche sports cars. It has a top speed of just below 180 miles per hour and can travel a full quarter mile from standstill in 10.1 seconds. The front forks are titanium covered and the braking system is via advanced twin hydraulic discs on the front and a single disc to the rear.

Eyewitnesses said he had been travelling at a very high speed and acceleration. A vehicle travelling in the opposite direction reportedly turned left into his path, causing a head-on collision.

One feature of the Suzuki that Benjamin was riding is that it has a tuning valve inside the exhaust pipe that reacts to the acceleration of the motorcycle to dampen sound. It is said to be a quieter exhaust than a similar motorcycle with only 60 per cent of the cubic capacity.

The driver of the motor car was arrested in relation to offences pertaining to his documentation.

Shots fired at vehicle

PHILIPSBURG--Shots were fired on A.Th. Illidge Road near the Windward Islands Bank building in the early hours of Thursday morning.

The target was a motor vehicle travelling towards Dutch Quarter, according to sources. The reason for the shooting is unknown as yet.

Witnesses to the police search of the area indicate that the police may have found some bullet casings on the ground.

When contacted by The Daily Herald Thursday about the incident, police spokesman Inspector Ricardo Henson said, "I cannot tell you very much at this time, until the detective's report is filed. I am aware that an incident took place and that shots were fired, but I will be able to tell you more tomorrow."

No indication has been received that any injuries were sustained.

Iraq largest refinery closed after attack

Iraq's biggest oil refinery was closed on Saturday after gunmen carried out a bomb attack and set it on fire, the governor of Salahuddin province said.

The attackers killed four people and planted bombs at production units for kerosene and benzene at the refinery in the town of Baiji, about 180 km north of Baghdad, Governor Ahmed al-Jubouri told Reuters.

The refinery operates at 70 percent of its capacity and produces 11 million litres of gasoline, 7 million litres of benzene and 4.5 million litres of kerosene a day.

It benefited from tax exemptions and successive amendments to its directive plan and today, is selling for $30,000 the 1 meter that she bought for $800. -�The high relief commission: the commission receives donations and distributes them outside the governmental budget framework, in other words, away from any parliamentary supervision.According to the agenda of expenditure submitted by the Ministry of finance, the total of its expenditures since 2006 equals to around $1.5 billion dollars, that of course, without mentioning the donations and expenses not covered in the budget. Lawyer says Pelican hiring new staff ?at their own risk?

PELICAN--Attorney Maarten le Poole says Pelican is hiring new staffers at its own risk.

"Pelican has pledged that the hiring of any new employees - which is apparently being done at this time to an unknown scale - will not be to the detriment of any existing employment contracts with members of WIFOL, indicating that they will be hiring those new employees at their own risk," Le Poole told The Daily Herald via e-mail.

"Based on this, the judge deemed it unnecessary to prohibit Pelican to hire any new employees for the duration of the injunction, as had been requested by WIFOL," Le Poole said, referring to the court injunction filed on behalf of the union against several parties involved in the Pelican case. The case will be called this Thursday, February 3, at 9:00am.

The Pelican workers have suspended their protest actions pending the outcome of the injunction. The workers met with their union at the WIFOL building on Monday for an update on the court case. They later joined the teachers and civil servants, who had also been meeting with their unions at L.B. Scott Sports Auditorium.

Items confiscated from containers at shipping company?s warehouse

~ Businessman says he's being targeted~

PHILIPSBURG--The Inspectorate of Public Health VSA confiscated an undisclosed quantity of items from containers belonging to at least two businesses at Tropical Shipping Warehouse on Thursday.

Inspector of Pharmaceuticals Ashanti van Heyningen declined to release information on the incident when contacted on Friday, but promised to give details next week via Government Information Services (GIS). She said releasing information at this stage will jeopardise the investigation.

Lucky's Managing Director Prakash Menghani, one of the business owners from whom items were confiscated, told The Daily Herald that 63 cases of Century 22; 3 cases of Septicon and two cases of Jarabrompebecho imported from the Dominican Republic and valued at about US $5,000 were confiscated from him.

The Lucky's official said Century 22 is a blood cleanser, Septicon a mouthwash for cold and throat infections and Jarabrompebecho, a garlic vitamin for cold. The Daily Herald understands that items from another business with links to the Dominican Republic were also confiscated.

Chief Customs Officer Anthony Doran confirmed that Customs was involved in the exercise with the Inspectorate, but directed this newspaper to the Inspectorate of Health as it is an investigation started by that department. He said Customs usually assists its partners.

Menghani said he had been summoned to the warehouse early Thursday afternoon and was told that he was not allowed to bring in those specific items confiscated because they were not registered. He was given a letter from the Inspectorate to this effect and was told that the merchandise would be held "until further notice."

Menghani said the items confiscated from him are sold over the counter and are well known around the Caribbean. He doesn't understand why these specific items had to be confiscated. He said he is in the health and beauty business and these are some of the items that are sold. He also contended that there are many items that are not registered, but are being sold.

He said too that he has been in this line of business for more than a decade and a half, selling similar items "and suddenly they came [Thursday] and they told me I'm not allowed to sell them."

The businessman said while he doesn't mind registering the products, he is unaware of the procedures to follow. He expressed willingness to register the items if the Inspectorate cooperates with him and guides him on the procedures he needs to follow.

Alluding to previous occasions in which inspectors swooped down on his business, Menghani said he feels as if he is being targeted and singled out. He said he didn't know why anyone would single him out and suggested that maybe his business was "interrupting" someone. He said the last time he was visited by inspectors he had been told that he wasn't allowed to sell certain items.

He said now he has been told he's not allowed to bring in certain items. "Every time they say something different; next time it will be something else," he said. "I'm in the health and beauty industry. This is a normal product that is available in every market. I find it's very unfair because we are in a democratic market and [we bring in items] based on demand."

Items imported, he said, are wholesaled and retailed; they are not sold to pharmacies.

WIFOL: Resort?s ?flimsy excuses? no reason for staff, owners ?shut out?

Calls for audit, says Govt needs to take stand

PHILIPSBURG--Workers Institute for Organised Labour (WIFOL) President Theophilus Thompson has accused Simpson Bay Resort Management Company (SBRMC), the new management of Pelican Resort, of "playing games" and says there are no reasons for the resort to be closed and workers and homeowners to be "shut out."

Thompson told The Daily Herald late last night that the company's excuse of "unforeseen circumstances" as one of its reasons for closure was not clear. He said it was time for government to take a firm stand on this issue.

"The new company has shut out the workers from their jobs even though they [workers, ed.] have won the court proceedings. They are also shutting out the homeowners from their vacation weeks with flimsy excuses and I am concerned about the position of government in allowing the new owners to shut out the employees and now the homeowners to their vacation weeks which they have already paid for," Thompson said.

"The reasons that they are giving are lousy reasons. There is no need for the resort to be closed while they're sending homeowners correspondence that the property will remain open and they will have security guards, maintenance personnel and management working and offices open. This is conflicting."

Thompson said the objectives and "excuses" being given were unclear, "lame," "weak" and "lousy."

"I don't see why the resort has to be closed and why they continue to lock out members of WIFOL and lock out tenants from enjoying their vacation. There is no reason. Nothing is wrong with the rooms. Let the people come to enjoy the vacation and if they have problems, they have to work them out.

"They're saying 'unforeseen.' Come on, be real. They have other reasons which they are not being clear and open about. Their action is speaking louder than their words. They can't just make excuses and say things. They have to prove it. The Labour Department should get an independent financial company to do an audit if they claim they have financial problems."

Thompson said the union was not involved in the talks coordinated by Prime Minister Sarah Wescot-Williams.

He said the union had received two phone calls ? one from Raphael Boasman and the other from a representative of the St. Maarten Timeshare Association (SMTA) ?enquiring whether the union was open to dialogue with the company.

"I told them 'yes.' WIFOL has always been open to dialogue and to discuss a new collective labour agreement. We are willing to discuss the way forward, not in going backward. The employees are already with the new company, according to the judge's decision, and they are being paid by the new company.

"The new owners have to move forward, and if they have St. Maarten's interest at heart, as investors they should stop playing games and government should take a stand."

Thompson said it was the high season and "St. Maarten doesn't have the space to accommodate Pelican timeshare owners. Other timeshares are full because it's the high season. The resort should remain open and the employees who they have should be back on the job. Government should do something, because they are doing nothing."

MARIGOT--Opposition party Rally, Responsibility, Success (Rassemblement Responsabilit� R�ussite (RRR)), headed by Territorial Councilman Alain Richardson, has come out in defence of St. Martin's small businesspersons, fishermen, market vendors and bus and taxi drivers and against the UP/UMP government's move to replace the professional tax.

The Territorial Council deliberated on the tax change on Thursday. The new system proposed is based on a dual mechanism (a licence tax and a levy of fixed assets).

Richardson said in a press release that this mechanism "favours greatly large companies that have for their operations large buildings and lands [...] and penalises greatly small and very small businesses," that represent close to 90 per cent of businesses in the Collectivit�.

RRR presented several amendments during Thursday's session that were "retained, validated and adopted" by the council.

These amendments will now permit market vendors to benefit from a general rebate of 50 per cent, thus preventing the penalisation of this profession. Vendors would have seen their tax more than double if government's initial text had been adopted, whereas their yearly tax for 2011 is now limited to 200 euros.

Taxi and bus drivers are to benefit from a total exemption (as with the Professional Tax), while under the government's proposed text they would have been seriously taxed.

A further amendment is that all new businesses are to benefit from a total exemption for the first year, an exemption of the levy on fixed assets for the second year and a 50-per-cent rebate in the third year. Under the government's proposed text they would have been fully taxed from the beginning, according to RRR.

The Collectivit� will collect a minimum amount of tax resources from the larger companies that, under the original proposal, would have seen their contributions substantially slashed.

The mechanism proposed by RRR now sets a minimum yearly contribution scale based on business size (level of yearly sales); this reintroduces more fiscal justice.

Richardson also tabled for RRR a tax-incentive modification for fishermen to aid by reducing fuel cost. He presented an amendment to the Gas Tax Law that would grant a total exemption from the government's fuel tax of six euro cents per litre for all registered fishermen.

The five-seat RRR sees its achievements for small business and defence of the Collectivit�'s financial interests as clear indications and proof of its effectiveness and commitment to serve the people and in line with the slogan, "Together, let's make it happen in 2011."

RRR "vehemently denounced" the fact that, over the Collectivit�'s four years of existence, the Council had been called to create, modify and adjust taxes, yet no substantial data, no simulations and no evaluation of the various scenarios had been presented or offered.

"This blind way of governing after four years of UP/UMP government is irresponsible and unacceptable," RRR said via Richardson. "How can the population have confidence in such a government? How can the tax payers understand and adhere when government cannot even evaluate the impact and justify its choices?"

The group said the government of President Frantz Gumbs was again bowing to the dictate of the French Tax Services in that, after imposing the suppression of the "Inhabitancy Tax" in 2009, was now doing the same with the Professional Tax behind fallacious excuses (of non-operational software to prepare assessments for 2011).

The group made it clear that, with the critical financial situation of the Collectivit�, this suppression of 10 million euros of assessed tax, for an average yearly collected amount of five million euros, would be a fatal blow for the finances and even the autonomy of the Collectivit�. It denounced this as "another violation" of the constitutional autonomy of the Collectivit� that President Gumbs had "not even protested against."

RRR said that any new tax structure or mechanism destined to replace the Professional Tax had to guarantee yearly at least the equivalent resources in tax collected as the Professional Tax as well as fiscal justice within the business community, and had to be an incentive for business creation, development and growth and not another hurdle to discourage anyone from getting involved in business.

Three are killed in motorcycle accident

page1a228MARIGOT--Two young people from the French side and one from the Dutch side were killed in a motorcycle accident on Mount Valois hill on Saturday around 10:45pm, when the two motorcycles travelling in opposite directions crashed head-on into each other at high speed.

Each motorcycle had been overtaking a vehicle that was travelling in front of it. The motorcyclists were thrown through the air and one was killed instantly. He was identified as Mirangelo Blijden (22), who lived on Bush Road, St Maarten.

Relatives of Blijden were very shocked by the incident and a cousin said, "I just heard about it an hour ago. I cannot believe that two motorcycles could have a head-on crash like this. From what I hear they were not wearing helmets. It is very sad."

The second motorcycle was carrying a young couple identified as Ginette Souklaye (18) and Joel Richardson (23). Both were critically injured and emergency service personnel fought desperately to save their lives. One of the injured reportedly was revived at the scene, but despite the best efforts of the emergency personnel both died shortly after their arrival at hospital.

None of the three persons involved in the accident was wearing a safety helmet.

Education Ministry stresses Monday regular school day

No pay for those who don't work

PHILIPSBURG--The Education Ministry has informed all school boards and teachers of public schools and those funded by government that Monday, January 31, "is a regular school day."

A press release issued by Education Minister Rhoda Arrindell's Policy Advisor last night stated that teachers and students "are expected to attend school normally and on time."

"In a letter to the school boards on Friday, January 28, the Ministry referred to the events of January 27 and 28, 2011, when teachers were called out by their union to a meeting during school hours, which resulted in students being denied education," it was stated in the release.

"The letter stated that this cannot be supported by the Ministry of Education, Culture, Sports and Youth Affairs because, according to the letter, all possibilities to arrive at an amicable settlement between government and the union without industrial action were not exhausted."

The letter concluded by stating, "In the event persons fail to comply with the directives of the Ministry, the policy of 'no work, no pay' will be applied."

Earthquake near north coast of Trinidad

On Friday, February 04th at 08:16 a.m., local time, an earthquake occurred north-west of Trinidad. The event was located at 11.36�N, 61.87�W. The preliminary magnitude was 5.1 and the depth was 144 km. The earthquake was reported as felt throughout Trinidad, from Carenage to Princes Town to Sangre Grande. The event was also reported felt in Tobago, Grenada, St. Vincent and Saint Lucia. No damage or injuries were reported to the Seismic Research Centre. Please note that these results are preliminary and may vary slightly when additional data are processed.

NO TSUNAMI WARNING HAS BEEN ISSUED.

No breakthrough, so Pelican closes

Page1A234PHILIPSBURG--The breakthrough for which Prime Minister Sarah Wescot-Williams says she was hoping in the Simpson Bay Resort and Marina (formerly Pelican Resort) saga did not materialise over the weekend and the resort closed yesterday, Sunday.

There was no official statement from the new owner of one of the island's leading timeshare properties, but a chain across the driveway of the entrance to the closed resort told the grim story that has left close to 200 workers pondering their fate and hundreds of timeshare investors agonising about their investments.

Workers Institute for Organised Labour (WIFOL), which represents the Pelican workers, confirmed Sunday that it had not succeeded in its bid to avert the resort's closure.

In a press release last night, the government's Department of Communication DCOMM reported Wescot-Williams as saying that while the breakthrough for which she had hoped had not materialised over the weekend, the door on reaching an agreement had not been closed and she believed a possible breakthrough remained under review by the parties.

"At this time I will not go into details, as parties involved have agreed to refrain from such. I remain hopeful that this breakthrough can still come within the next 24 to 48 hours," Wescot-Williams was quoted as saying. "If such is the case, my focus will turn on the steps which will have to be taken by all parties to effectuate the reopening of the Pelican Resort as soon as possible.

"If the prospects of reaching an agreement fade in the next 24-48 hours, government ? while respecting parties' views with respect to the initial court verdict ? will at the same time explore any and all avenues open to government to expedite a solution.

"These solutions will respect the rule of law, but will put the general interest of our island's image and its work force at the fore."

Meanwhile, WIFOL's attorney Maarten le Poole of HBN Law said WIFOL had been hoping to avert the closure with a direct meeting with Simpson Bay Resort Management Company (SBRMC) on Friday, but that had not happened.

"Since there was no direct meeting this has not been accomplished and now we have to see what will happen next week [this week, ed.]," Le Poole said on Sunday. "The closure of the resort takes a bit of the leverage out of it, because this is what WIFOL wanted to avoid."

WIFOL President Theophilus Thompson told The Daily Herald on Sunday that the meeting on Friday with special government mediator Raphael Boasman had been "the same old story." He said "nothing substantial" had come out of the meeting.

"There was nothing of importance to talk about," he said, adding that Boasman had to get back to the union, but up to the time this newspaper spoke with him Sunday afternoon, Boasman had not re-established contact.

Le Poole said he did not understand where the timeshare owners were in terms of "enforcing their rights."

"It is not only WIFOL's responsibility to keep the resort open and government can't prevent closure on its own. I don't understand. Where are the timeshare owners and why didn't they go to court to prevent closure?" he asked. "They have to get their priorities straight. At least this is what I understand.

"It's unfortunate that last week we couldn't get around the table to prevent the closure, but maybe next week [this week] there's an opening to speak, but I'm not hopeful if it closes today [Sunday]."

HBN attorney Wim van Zambeek said over the weekend that the timeshare owners should take the company to court and the company's licence should be revoked if the resort were closed.
