Dutch Parliament ignores overseas colleagues’ wish

THE HAGUE--The Dutch Parliament's Second Chamber is disregarding the urgent appeal of the Parliaments of Aruba, Curaçao and St. Maarten to postpone handling the Visa Law and the Law on Dutch Citizenship until after the Dutch elections on September 12.

Chairpersons Paul Croes (Aruba), Ivar Asjes (Curaçao) and Gracita Arrindell (St. Maarten) made their appeal in an April 29 letter to the Second Chamber. However, the Second Chamber's Permanent Committees for Interior Affairs and Foreign Affairs decided in separate meetings on Thursday that they would not declare either law proposal controversial. This means that the handling of these law proposals can go ahead regardless of the pending elections.

A majority in the Committee for Foreign Affairs, comprising the conservative VVD party, Labour Party PvdA and Christian Democratic Party CDA, among others, not only ignored the wish of the overseas Parliaments to hold off on handling the Visa Law (Rijksvisumwet), but also the protests of the Party for Freedom PVV, Socialist Party (SP), the democratic D66 party and the Christian Union (CU).

Member of Parliament (MP) Harry van Bommel (SP) was the only one to bring up the letter from the Chairpersons of the overseas Parliaments. He defended their plea and proposed declaring the Visa Law controversial. "The request of the Parliaments of Aruba, Curaçao and St. Maarten should weigh heavily in our decision," he said.

In the Interior Affairs Committee D66, CU and the green left party GroenLinks tried to delay the handling of the Law on Dutch citizenship (Rijkswet op het Nederlanderschap) until after the September 12 elections, but to no avail, because a majority didn't want to declare this law proposal controversial.

The Parliaments of Aruba, Curaçao and St. Maarten are objecting to the two laws in question. The Visa Law would curb the autonomy of the countries too much and hurt trade relations with countries in the region.

The Law on Dutch Citizenship would make it no longer possible for Dutch citizens to have dual nationality. The PVV has been a fervent proponent of this law proposal, because the party doesn't want naturalised immigrants to have two passports.

"This law proposal brings great uncertainty for one million Dutch citizens in The Netherlands and a group abroad, as to whether they will be able to hold on to their other passport. This is a vital matter for them," said MP Martijn van Dam (PvdA), who asked to declare the law proposal controversial.

"There is much fuss over this law proposal. Let's leave it to the new Second Chamber," said Sadet Karabulut (SP), who also wanted it declared controversial. The Committee for Interior Affairs decided to arrange a couple of hearings before handling the law.

A plea by MP Cynthia Ortega-Martijn to declare controversial the law proposal to amend the Constitution to formalise the public entity status of Bonaire, St. Eustatius and Saba proved futile as well. "This goes against the agreement that we have made to hold off on a final status until the evaluation in 2015," she said.

"We should give the islands a chance to grow into adults. Besides, the people of the islands should be allowed to express themselves before we take a definite decision on their constitutional status in the Constitution," said Ortega-Martijn in an invited comment. According to her, this is another prime example of why the islands should have a say in the Second Chamber. "We have to listen more to them."

Parliament will take a final vote on the list of controversial law proposals and initiatives sometime next week.

Today Sunday May 27 at 0700 am London time the attached image which I took in Al Mussayyib in Iraq on March 27, 2003 (see caption below) was front page on BBC web site illustrating the massacre that happen in Houla the Syrian town and the caption and the web site was stating that the images was showing the bodies of all the people that have been killed in the massacre and that the image was received by the BBC by an unknown activist. ‘Voluntary leave’ for 15 TelEm employees

PHILIPSBURG--TelEm Group management has confirmed that the company has granted "voluntary leave" to fifteen personnel of various departments within the TelEm Group. At the same time, management has denied five additional employees' requests for voluntary leave and has informed these employees accordingly.

In a press release Sunday, the TelEm Group management did not explain what was meant by "voluntary leave," but the decision is seen to be in keeping with the government-owned group of companies' bid to "right-size" itself by "downsizing" and operating with a reduced staff.

It was explained in the press release that the decision to grant voluntary leave had been taken by the group's Management Board on May 2 and 3, in continuing discussion with union representatives.

The TelEm Group explained that the Management Board believed the five employees not granted voluntary leave most likely could be placed in the new operating company (based on the company's Formation Plan) or that the TelEm Group reasonably could state that these persons otherwise would receive reasonable offers for functions in the new operating company.

TelEm has assured that the company's personnel and all stakeholders are being informed of these developments on an ongoing basis and have been told to expect other decisions in the restructuring process to be taken within the coming weeks.

TelEm Chief Financial Officer Helma Etnel said management viewed these latest developments as internal actions that it would be implementing in full consultation and discussion with the union and employees.

"This is a very sensitive time for all parties concerned and we trust that the public and the media will understand that we prefer to handle these matters internally and out of the public spotlight, in order to maintain the confidential nature of this process," Etnel said.

LIOC diesel up by Rs. two

The price for a litre of Lanka India Oil Company (LIOC) diesel has been further jacked up by Rs. two from midnight today, a spokesperson for the company said a short while ago.

The LIOC had earlier sought approval to raise the price of diesel by Rs. 10 saying that it was facing losses.

The prevailing price for a litre of LIOC diesel is Rs. 115.

Two more women killed in Kahawatte

Two women who were burnt to death inside a house in Kahawatte have been found by the villagers.
 
The women identified as Hethuge Dayawathi, 58 and Hethuge Thilakwathi 51,  were residing in Warapitiya, Kahawatte where the incident took place.
 
More than 10 women have already been killed in the Kahawatte area during the past two years.
 
In January a mother and daughter were also killed in the Kahawatte area.

Air Arabia ranked first for punctuality at Moscow airport

Air Arabia, the first and largest low-cost carrier (LCC) in the Middle East and North Africa, announced today that it has been ranked first for the punctuality of its outbound flights from Domodedovo International Airport, Moscow. 

Figures released by the airport show that 100 per cent of Air Arabia flights in April 2012 departed on-time, earning it the accolade of “Most Punctual Airline” at Domodedovo International Airport. The competition included all international airlines.

Fête du Nautisme revives interest in marine sector

Page9B300MARIGOT--The two-day Fête du Nautisme organised by marine trades association Métimer and French-side sea rescue organisation SNSM began at the Marigot waterfront over the weekend with scores of people enjoying the many marine activities on offer.

Proceeds from the Fête will be given to SNSM towards the cost of a new engine for the SNSM 129 lifeboat, but officials said Sunday it was too early to ascertain how much money had been raised or how many people had participated in activities.

The renaissance of this Fête, which was held last in 2005, bodes well for Métimer which had declared the event a "success" by the end of the day.

Métimer contends that the more interest there is in water sport activities the more the likelihood that a percentage of the population will be encouraged to start a business or begin a career, thereby stimulating and perpetuating the marine industry in St. Martin as a whole. For this reason, Métimer is seeking to rekindle interest in the sector.

The future potential is likely to emerge from Saturday's activities, which involved taking some 200 youngsters ages 14-16 to Tintamarre Island for a discovery day of sailing, swimming, kayaking, paddle boarding, water skiing, diving, snorkelling and tours of Tintamarre led by Réserve Naturelle rangers to discover flora, fauna and marine eco-systems. Many owners of vessels contributed their time to assist transporting the students to the island.

"The students were very well-behaved. We were pleasantly surprised that it went better than last year," said a Métimer board member describing the Tintamarre excursion. "The Lycée organised a delicious lunch and it all went really well."

The aim on Sunday was to introduce the population to the many marine activities available, including kayaking, paddle boarding, sailing, jet skiing, helmet diving, etc. For a nominal fee persons could sign up for the activities at the SNSM headquarters or participate in the free demonstrations.

The board indicated that jet skis and helmet diving by H20 had been the most popular activities.

There was a parade of catamarans in the bay at the end of the day while a good crowd settled into a happy-hour mood listening to the live band GTO.

Métimer President Bülent Gülay said the Fête had been organised with a budget of 16,000 euros and he was very pleased with the outcome of the event. The Collectivité and St. Martin Tourism Office were not able to participate due to financial constraints.

"We were not able to choose the date for this Fête as it is a national event held all over France on this weekend in 700 locations. There were some other events coinciding such as the regatta in Anguilla and in Orient Bay and Le Galion, but all things considered we had a good turnout and a lot of people enjoyed the activities," he said.

Gülay added that next year's event would be even bigger and better thanks to an increased and enthusiastic Métimer membership and continued support of companies such as Island Water World and Budget Marine. He envisaged the event would be integrated with a second-hand boat show and not be restricted to the national dates for Fête du Nautisme.

There is also the possibility of soliciting funds from Europe.

"We will be applying for European funds and hope that we can have a budget in the region of 100,000 euros, which will allow us to organise something quite special with a second-hand boat show. There is a lot of interest in this in the region," he said.

Laville doesn’t know what Rhoda is talking about

PHILIPSBURG--Member of Parliament Romain Laville said on Monday he does not know what Minister of Education Rhoda Arrindell was referring to in her comments on the dismissal of the director of S4.

Over the weekend Arrindell linked the recent dismissal of S4 Director Marva Richardson by the board of S4 to Laville's recent decision to serve as an independent MP supporting a government to be led by the National Alliance.

Arrindell identified the treasurer of the S4 board as the person "who apparently orchestrated the demise of the S4 director" and who also had been "parading himself as the advisor to MP Romain Laville and the NA fraction. Could it be a coincidence that the S4 director was fired immediately after the so-called 'Carnival coup' to bring down the UP-led coalition government?" she asked.

Laville said simply that he wasn't familiar with the issues at S4 or those surrounding Marva Richardson and had no idea who the treasurer of S4 was. "And I'll leave it at that."

St. Maarten father raped daughter since she was 6

GRONINGEN--Calix W. (52) from St. Maarten sexually abused his daughter since she was six years old. He made her pregnant when she was 11. The man is now on trial and the Dutch Public Prosecutor's Office on Monday demanded ten years in prison.

Horrific details emerged during Monday's trial in Groningen, The Netherlands. According to the Prosecutor, the suspect started sexually abusing his daughter when she was six years old. She was sexually abused at least 300 times over a period of several years.

The daughter delivered a healthy baby girl during a school trip just outside the city of Groningen in March last year, when she was just 12 years old. Initially the man denied that he had made his daughter pregnant, but a DNA test proved that he was indeed the father.

The Prosecutor said that the daughter would be scarred for the rest of her life, also because she would always remain the mother of her father's child. The Prosecution demanded ten years, two years under the maximum punishment for sexually abusing a person under the age of 12.

On the order of the Court, the father had to undergo extensive psychological testing at the Pieter Baan detention centre for psychiatric observation in Utrecht. That is why the trial took long to materialise.

In 1995 a Court in The Netherlands sentenced W. to 15 months in jail for sexually abusing one of his other daughters in 1994 and 1995, who at that time was also 12.

When W. left prison, he made two more children, including the girl that he made pregnant. The mother left in 2002. In 2004 W. was granted guardianship over the two minor children, despite the earlier conviction for incest. The Court didn't know about the earlier sexual abuse, because the file had been destroyed in keeping with the laws on privacy.

The daughter and the baby, along with her younger brother, are living with a foster family and have been placed under the supervision of the Youth Care Bureau.

Leadership training for new university entrants again

 The leadership programme conducted by the Ministry of Higher education for the newly selected university students will begin on May 27 in 24 centres islandwide, spokesmen to the Ministry said. 

This is the second consecutive programme and 10,000 students are expected to undergo the training programme until July 15. 
 
According to the Higher Education Ministry this year’s programme has been planned with the suggestions received from students participated the event last year, parents and University academics.
 
The students are expected to report to their training centres before 6 p.m on May 27.  
 
Last year’s leadership training programme ran into controversy with claims that students were given a military training.

Lottery manager sentenced for gun

PHILIPSBURG--Robbie's Lottery manager Jacques de Castro (52) was sentenced Wednesday to 12 months suspended, with two years' probation for keeping an unlicenced firearm in a drawer of his office desk.

De Castro will also have to pay a NAf. 1,500 fine. In case he would not pay this fine, he would have to spend 60 days in prison.

His lawyers Eldon Sulvaran and Jairo Bloem had claimed the search of the lottery office was illegal and, therefore, the case against their client should be thrown out.

Judge Monique Keppels rejected this claim, and stated the documents which the defence lawyers had wanted to see concerned the cases against Robbie's Lottery's boss Robbie dos Santos, Caribbean Investment Group Ltd. and Jamaroma Lotteries NV.

The fact that the defence lawyers were not able to see these documents, therefore, did not constitute a violation of their client's rights, the Judge stated.

Judge Keppels found it legally and convincingly proven De Castro had been in possession of a .380 calibre Jennings firearm and ammunition that were found during a search of the Robbie's Lottery office on Cannegieter Street on July 12, 2011.

Members of the Kingdom Detective Cooperation Team RST paid a visit to Robbie's Lottery headquarters as part of a major investigation headed by RST and assisted by the Intelligence and Investigations Team (TIO) of the Foundation Tax Accountants Bureau in connection with an investigation into money-laundering, tax fraud and forgery in Curaçao and St. Maarten.

The so-called "Bientu" investigation, which was launched in 2008, also focused on Caribbean Investment Group and Jamaroma.

De Castro, who was held for 10 days, was not charged with involvement in any financial crimes.

Inmates cause fracas at jail over conditions of facility

SIMPSON BAY--Inmates in the cells of the Simpson Bay police substation physically rebelled on Tuesday afternoon at approximately 4:30pm as a result of what was described by reliable sources as "pent-up frustration" over the conditions of the facility.

Minister of Justice Roland Duncan on Wednesday said he was apprised of the incident but preferred to wait until he is presented with an official report before briefing Parliament as well as the public as to what happened. "The situation is, however, under control," the Minister said.

The Daily Herald learned, however, that about 5 inmates started taking their frustrations out on the automated push-button doors, breaking glass and tables, and fought with the guards of the facility. Pepper spray had to be used to calm the situation.

Prison guards called for back-up in the form of police assistance but, reportedly, police arrived on the scene close to a half hour after the incident was over. This was unconfirmed by press time on Wednesday. The entire disturbance lasted about 30 minutes.

While it is unknown what triggered the inmates' action, some of their grievances are outlined in a letter from one of the inmates on the opinion pages in this issue. These include, but are not limited to, lack of medical attention, sanitary issues and accusations of unprofessional behaviour by the guards.

Scot expresses sorrow, calls for patient transport policy

CAY HILL--St. Maarten Medical Center (SMMC) Board of Directors Chairman Dr. George Scot has expressed sorrow over the tragic medivac accident that claimed the lives of four people over the weekend.

Scot explained that the patient, a cruise ship passenger, had been admitted to the ICU last week Thursday with a serious cardiac condition. One of the rotating cardiologists from Holland, who provides cardiological care at SMMC two weeks per month, was present at that moment to attend to the patient.

"On Friday the patient's condition worsened. At that time there was a medical indication for the patient to be referred to a specialised cardiological centre. In order to have the patient evacuated, the patient's insurance company needs to give approval for transport by air ambulance to the receiving hospital, in this case located in Martinique," Scot explained.

"After the medical indication has been confirmed by specialists and it has been established that the required medical care can be provided by that institute, the receiving hospital will accept the patient. Friday afternoon we received clearance from all parties concerned and the patient left SMMC on Friday evening with a special medical team of the hospital in Martinique by ambulance to Princess Juliana International Airport."

Scot said SMMC had not been informed that the air ambulance at Princess Juliana Airport had technical difficulties or that the patient had been transported from Princess Juliana International Airport to Grand Case Airport.

"If the patient's condition exceeds the treatment options at SMMC, it is to the medical judgment of the treating physician to refer a patient to a different hospital in order to receive proper care. The responsibility of the SMMC and the specialists at SMMC is to provide the necessary medical information timely to the insurance company of the patient and to arrange the ambulance to the airport," Scot said.

"The insurance company of the patient is responsible for arranging the transport to the receiving hospital. In most cases the insurance companies have their own contract with the air ambulance services and hospitals in the region."

Scot said it was important that a full investigation be carried out on how the tragic accident could have occurred. Even without the results of that investigation, he continued, "it would be wise that a policy is made for air transportation of patients of both the Dutch and French side and those strict guidelines for air ambulance services are agreed upon. The size of the population of St. Maarten/St. Martin together, and that of Saba and St. Eustatius plus the limited medical services to these islands, justifies such a policy.

"Staff, specialists and management of SMMC truly regret the tragic accident and we wish the family members, colleagues and friends of the deceased much strength in dealing with their unexpected tragic loss."

PHILIPSBURG--Government should be able to pay the cost of living adjustment (COLA) for 2010 by June 30, Finance Minister Hiro Shigemoto announced Thursday night.

Shigemoto, who is currently serving as the caretaker Minister of Finance, said the payout should be "to the tune of NAf.17 million – inclusive of back service pension premiums."

The payment should have been made to government workers since January, but due to difficulties in putting together the 2012 budget this was not done.

Windward Islands Teachers Union (WITU) President Claire Elshot had said at a press conference earlier Thursday that the union hoped the COLA would be paid at the end of June together with the vacation pay. She had raised concerns that if the vacation pay was paid before the COLA and not together there would be need for recalculations.

In his press release last night, Shigemoto explained that his Cabinet "has been working diligently to secure the necessary funding" to meet government's obligations towards civil servants of Country Sint Maarten.

"The funding will come from the 2010 balance sheet prior to 10-10-10 and 2011 extended book year financial statement for which provisions have been made to the tune of NAf. 11 million and NAf. 2 million respectively, and the remainder, approximately NAf. 4 million, will be covered from the cash reserves," Shigemoto explained.

He cautioned that the arrangement would have to be approved by the Committee for Financial Supervision CFT and that discussions with the CFT would commence on a technical level.

The press release continued: "The Financial Statement 2010 prior to 10-10-10 is still being checked by the SOAB Accounting Bureau, and the 2011 Financial Statement is being finalised to be checked by the SOAB and subsequently to be forwarded to Parliament in August 2012."

He also stressed that a long-term solution had to be worked out with all stakeholders, as the current arrangement will not be sustainable in the coming years.

Meanwhile, the WITU board still has to be informed officially of government's plan to pay the COLA.

The union's board met Thursday evening to finalise an agenda for a May 12 general membership meeting. The COLA payment and tackling absenteeism are expected to feature prominently on the agenda.

A Putsch against War

Generals and secret police chiefs get together for an attack on the politicians.

In some countries, they arrest the president, occupy government offices and TV stations and annul the constitution. They then publish Communique No. 1, explaining the dire need to save the nation from perdition and promising democracy, elections etc.

In other countries, they do it more quietly. They just inform the elected leaders that, if they don’t desist from their disastrous policies, the officers will make their views public and precipitate their downfall.

Such officers are generally called a “junta”, the Spanish word for “committee” used by South American generals. Their method is usually called a “putsch”, a German-Swiss term for a sudden blow. (Yes, the Swiss actually had revolts some 170 years ago.)

What almost all such coups have in common is that their instigators thrive on the demagoguery of war. The politicians are invariably accused of cowardice in face of the enemy, failure to defend national honor, and such.

Not in Israel. In our country we are now seeing a kind of verbal uprising against the elected politicians by a group of current and former army generals, foreign intelligence and internal security chiefs. All of them condemn the government’s threat to start a war against Iran, and some of them condemn the government’s failure to negotiate with the Palestinians for peace.

Only in Israel.

It started with the most unlikely candidate to lead such a rebellion: the ex-Mossad chief, Meir Dagan.

For eight years, longer than most of his predecessors, Dagan led the Mossad, Israel’s foreign intelligence service, comparable to the British MI6.  (“Mossad” means “institute”. The official name is “The Institute for intelligence and Special Operations”.)

Nobody ever accused Dagan of pacifism. During his term, the Mossad carried out many assassinations, several against Iranian scientists, as well as cyber[ ]attacks. A protégé of Ariel Sharon, he was considered a champion of the most aggressive policies.

And here, after leaving office, he speaks out in the harshest terms against the government’s plans for an attack on Iran’s nuclear installations. Not mincing words, he said: “This is the stupidest idea I have heard in my life.”

This week he was overshadowed by the recently relieved chief of the Shin Bet. (Shin Bet and Shabak are different ways of pronouncing the initials of the official Hebrew name “General Security Service.”) It is equivalent to the British MI5, but deals mostly with the Palestinians in Israel and the occupied territories.

For six years, Yuval Diskin was the silent chief of the silent service. His shaved head could be seen entering and leaving meetings of secret committees. He is considered the real father of “targeted eliminations”, and his service has been widely accused of extensive use of torture. Nobody ever accused him of being soft on Arabs.

And now he has spoken out. Choosing a most unusual venue – a get together of some two dozen pensioners in a small-town cafe - he let fly.

According to Diskin – and who would know better? – Israel is now led by two incompetent politicians with messianic delusions and a poor grasp of reality. Their plan to attack Iran is leading to a world-wide catastrophe. Not only will it fail to prevent the production of an Iranian atom bomb, but, on the contrary, it will hasten this effort, this time with the support of the world community.

Going further than Dagan, he stated that the only factor preventing peace negotiations with the Palestinians is Netanyahu himself. Israel can make peace with Mahmoud Abbas at any time, and missing this historic opportunity will bring disaster upon Israel.

As chief of the Shin Bet, Diskin was the No. 1 official government expert on Palestinians. His agency receives and collates all the evidence, spy reports, interrogation results and information gathered from listening devices.

Leaving no room for doubt, Diskin said that he knew Netanyahu and Barak from close up, did not trust them and thought they were unfit to lead the nation in a crisis. He also said that they are deliberately deceiving the people. He did not omit to mention that they live in extreme luxury.

Anyone who thought that these accusers were lone voices, and that the whole choir of current and past security chiefs would rise and condemn them unanimously, was disappointed. One after another these experts were quoted by the media as agreeing with the two in substance, though not necessarily on their style. Not a single one questioned their assertions or denied what they said.

The current Chief of Staff and the Mossad and Shin Bet chiefs let it be known that they share the views of the two on Iran. Almost all their predecessors, including all the recent military Chiefs of Staff, told the media that they agree, too. Suddenly there was a united front of experienced security leaders against a war with Iran. 

The counter-attack was not late in coming. The entire battery of politicians and media hacks went into action.

They did what Israelis almost always do: when faced with serious problems or serious arguments, they don’t get to grips with the matter itself, but select some minor detail and belabor it endlessly.

Practically no one tried to disprove the assertions of the officers, neither concerning the proposed attack on Iran nor concerning the Palestinian issue. They focused on the speakers, not on what they said.

Both Dagan and Diskin, it was asserted, were embittered because their terms of office were not extended. They felt humiliated. They are venting their personal frustration. They are speaking out of sheer spite.

If they did not trust the Prime Minister, why did they not get up and resign while they were in office? Why didn’t they speak out before? If this was a matter of life and death, why did they wait?

Alternatively, why don’t they continue to shut up? Where is their sense of responsibility? Why do they help the enemy? Why don’t they speak only behind closed doors?

Diskin, it was added, has no idea about Iran. It was not in his area of responsibility at all. Dagan knew about Iran, but had a limited view. Only Netanyahu and Barak knew all the facts and the entire spectrum of opportunities and risks.

Sources “close to the Prime Minister’s office” also had another explanation: Dagan and Diskin, as well as their predecessors, were just stupid. Taken together with Dagan’s and Diskin’s assertion that Netanyahu and Barak are not rational (and perhaps not quite mentally balanced) this means that our national security depends entirely on a group of irrational and stupid leaders – and that this has been the case for years.

A frightening thought: what if everything they say about each other is true?

The man accused by his security advisers[ ]of messianic tendencies was exposed to personal scrutiny by another event this week.

His father, Ben-Zion Netanyahu, died at age 102, having remained of clear mind to the end. At the public funeral, he was eulogized by Binyamin. As could be expected, it was a kitschy speech. The son addressed his dead father in the second person – (“You taught me”…”You formed my character” etc) - a vulgar practice I find particularly distasteful. He also shed tears on camera.     

There is no doubt that the father had a huge influence on his son. He was a professor of history, whose whole intellectual life was centered on one topic: the Spanish inquisition – a traumatic chapter in Jewish history comparable only to the Holocaust.

Ben-Zion Netanyahu was an extreme rightist, obsessed by the idea that Jews might be exterminated at any moment, and therefore cannot trust any Goy. He held Menachem Begin in contempt, considering him a softy, and never joined his party. His intellectual attitude was reinforced by a personal trauma: his eldest son, Yoni, the commander of the spectacular Entebbe raid, was the only soldier killed in this operation.

It seems that he didn't have such a high opinion of his second son. He once remarked publicly that Binyamin was unfit to be prime minister, but would make a good foreign minister – an uncannily accurate judgment, if one sees the job of the foreign minister as marketing.

The home in which “Bibi” grew up was not a very happy one. The father was a deeply embittered man. As a historian, he was never accepted by the academic world in Jerusalem, who disavowed his theories. (Mainly, that the Inquisition did not persecuted the Marranos – Jews who had accepted Christianity rather than leave Spain – because they practiced Judaism in secret, but out of pure anti-Semitism. This was an attack on one of the most cherished tenets of Jewish mythology: that these Jews had remained true to their faith to the point of sacrificing their lives at the stake.) Not getting a professorship in Jerusalem, the father emigrated to the US, where Binyamin grew up. The father never forgave the Israeli establishment.

The myth of the Great Historian laboring at his titanic task was a daily reality at home, in America and, later, back in Jerusalem. The three sons had to walk on tiptoe, not being allowed to make any noise that could disturb the great man, nor to bring their friends home.

All this shaped the character and world view of “Bibi” – the specter of imminent national annihilation, the role model of the fiercely rightist father, the shadow of the older and much more admired brother. When Binyamin now speaks endlessly about the coming Second Holocaust and his historical role in preventing it, this need not be just a ploy to divert attention from the Palestinian issue or to safeguard his political survival. He may – frightening thought!!! – actually believe it.

The picture that emerges is exactly that painted by Yuval Diskin: a Holocaust-obsessed fantasist, out of contact with reality, distrusting all Goyim, trying to follow in the footsteps of a rigid and extremist father – altogether a dangerous person to lead a nation in a real crisis.

Yet this is the man who, according to all opinion polls, is going to win the upcoming elections, just four months from now.

Curaçao angry over ‘dictatorial’ TV item

THE HAGUE--The Curaçao Government is angry at producers of the Dutch TV programme Brandpunt for suggesting that the island is becoming a dictatorial state and that Prime Minister Gerrit Schotte is under mafia influence.

Curaçao's Minister Plenipotentiary in The Hague Sheldry Osepa came to the rescue of Schotte, who was in India at the time of the filming of Brandpunt's reportage in Curaçao last week. Osepa called the 15-minute item, which was broadcast on Dutch TV on Sunday, "highly objectionable" and announced that Willemstad would leave no stone unturned to correct this.

According to Osepa, the producers didn't keep to the journalistic rule of allowing someone who is being accused of something to tell the other side of the story. He also said that institutes in Curaçao such as Parliament were properly functioning and as such there was no question of a dictatorial government.

Osepa further said that Dutch Minister of Home Affairs and Kingdom Relations Liesbeth Spies had stated in the programme that no information of the Dutch intelligence agency AIVD had been leaked by the Curaçao Intelligence Service VDC.

Osepa's remarks have irked Member of the Second Chamber Ronald van Raak of the Socialist Party SP. He has posed written questions to Minister Spies on Monday on what he qualified as "threatening" remarks by Osepa.

Van Raak was one of the persons who were interviewed for the TV programme. In the interview he said it seemed that the mafia had sent Schotte to strip the VDC to see if there was damaging material. He called for an isolation of the Schotte cabinet. "We should not work with this government anymore," he said.

Osepa doesn't agree with Van Raak's statements, but he is angrier at two former PAR Ministers in Curaçao, David Dick and Omayra Leeflang, for their remarks to Brandpunt journalist Foeke de Koe.

Leeflang said in the interview that Schotte was committing an administrative "coup" by replacing people at government departments and government-owned companies who were critical of his administration. Dick spoke of Schotte's court convictions.

Osepa denounced that Leeflang and Dick were deliberately bringing down their island. "In The Netherlands and Europe we are working tirelessly on the promotion of Curaçao as a tourism destination and these efforts are wiped out by two of our own people. I find that sad," he told The Daily Herald on Monday.

Osepa said in Monday's edition of the Antilliaans Dagblad newspaper in Curaçao that the Schotte government would take counteraction against the TV programme. "You can expect us to leave no stone unturned," he said. On Monday he said that his government would take a decision on "the next step" this week.

Van Raak said he found it "unbelievable" that a Minister Plenipotentiary in The Hague would make such statements. "His response confirms exactly my concerns that Curaçao is dominated by fear and intimidation. This government clearly doesn't allow criticism and immediately responds with a threat," he said.

The Member of Parliament has asked Minister Spies for clarification. He wants to know, among other things, if she was going to protect the two "threatened" former Ministers, what she was going to do to stop "threatening language" by Osepa and whether the Minister Plenipotentiary was speaking on behalf of the Kingdom Council of Ministers.

Van Raak has asked the Minister to respond to his questions before the debate of the Second Chamber's Permanent Committee for Kingdom Relations with Spies this Thursday.

Joint Court orders early release of two convicted drug smugglers

~Judges rescind ministerial decision~

PHILIPSBURG--The Joint Court of Justice ordered the immediate release of two men Wednesday. They had been sentenced on appeal to five years and six months on March 24, 2011, for drugs smuggling.

Both men are foreigners and had appealed for early release. They also filed for appeal against their convictions at the High Court in The Hague, which is still to decide on their cases.

Minister of Justice Roland Duncan turned down the requests for early release, based on a policy that conditional release will not be granted to foreigners who are sitting out prison sentences of five years or longer.

The three judges of the Court of Appeals, however, came to the conclusion that the minister's policy is against the law.

Minister Duncan had introduced the new policy on 10-10-10 to combat illegal residence in St. Maarten and to curb the nuisance caused by criminal foreigners. The minister did not want to give the impression that St. Maarten is a country in which foreigners can commit serious crimes and jeopardise safety without carrying the consequences of sitting out the full length of their sentences. "St. Maarten cannot give the signal that crime pays," according to the Minister of Justice.

The Criminal Code provides in the early release of prisoners, upon the Minister of Justice's discretion. In deciding on such requests, the minister should adhere to principles of good governance.

In connection with his policy, the minister had referred to the National Ordinance Admission and Expulsion LTU and the ministerial order on electronic supervision.

The Appeals Court stated in its ruling it could not follow the minister in this standpoint, because the LTU is referring to the minister's authority on the issuance of temporary residence permits, and the expulsion and detention of illegal immigrants. The LTU does not apply to the early release of foreigners, the Joint Court stated.

The minister's authority to apply electronic supervision is also a separate and independent authority, next to his authority to decide on conditional release, the judges said.

During the April 11 closed-door hearing in this case, the minister's legal representative, attorney A.G. Baly, had submitted the Court with an undated and unsigned "internal" Ministry of Justice document, which contained criteria to assess requests for conditional release. In this document it was stated that no conditional release would be granted to foreigners who are convicted of prison sentences of five years or more.

According to information provided on behalf of the Minister of Justice this document was only distributed among the authorities concerned, among which were prison management, probation officers and the Prosecutor's Office. According to the Appeals Court it could not be ascertained whether the contents of the documents were also known among detainees and the population at large.

According to Minister Duncan the policy had been introduced on 10-10-10, and Joel J. Mark (42) of Grenada and Gerald R. Collet (44) of France had been the first to apply for early release under this scheme. This led the Appeals Court to the conclusion that it does not concern a lasting and established policy.

In the decisions to turn down the requests of early release, which were issued on January 30, and which were rescinded by the Appeals Court on February 16, it was stated the requests were denied because it would be impossible to keep requestors under supervision because they were illegal residents and would be expelled from St. Maarten.

In their decision, the Appeals Court judges also took into consideration that the prison and probation officer had given positive advice to the minister concerning the early release, and had indicated that both men's behaviour in jail had been exemplary.

The judges hereby also pointed to the fact that prison staff and probation officers had apparently not been aware of the minister's policy on early release. Therefore, the prisoners were confident their requests would not be categorically denied because they were foreigners, the Appeals Court stated.

Worries about St. Maarten as drug smuggling haven

THE HAGUE--The smuggling of drugs via St. Maarten worries The Hague, confirmed Dutch Minister of Home Affairs and Kingdom Relations Liesbeth Spies, who intends to bring up the functioning of justice and the combating of drug trafficking in the ministerial consultation next week.

The Minister made this promise to the Second Chamber's Permanent Committee for Kingdom Relations during a debate Thursday. She did so after Member of Parliament Eric Lucassen of the Party for Freedom PVV had expressed his concerns about the "extensive" drug smuggling via St. Maarten during the debate.

According to Lucassen, the United States is "very worried" about the role of St. Maarten in the drug smuggling route from South America to Europe and North America. Lucassen based his concerns on the recent crime view analysis (Criminaliteitsbeeld analyse) of St. Maarten by the Dutch National Police Service KLPD.

"Of the total world production of cocaine, about a third is smuggled via the Caribbean; yearly about 140,000 kilos. According to the US State Department, a part of that smuggling goes via St. Maarten's harbour," stated Lucassen. He said that with thousands of containers and yachts, and several million tourists, St. Maarten was a "true smuggling paradise."

The MP said that this was "logical," because the Customs Department on St. Maarten didn't function properly. "Even for Caribbean standards Customs is a joke." He asked Minister Spies about the capacity of the Customs Department and urged her to address St. Maarten's Government on this issue.

The Minister pointed out that the Dutch Caribbean Coast Guard was doing a good job in combating drug trafficking. "They are operating very effectively, but that doesn't mean that we are not concerned about the situation," she said.

Spies noted that border patrol was a responsibility of the individual countries of the Kingdom and that in St. Maarten the Royal Dutch Marechaussee was assisting the local Minister of Justice in this area.

Justice is one of the areas for which part of the plans of approach were drafted for St. Maarten when the island attained country status on October 10, 2010, because St. Maarten couldn't carry out this task completely on its own.

The Minister told the Second Chamber during the debate on Thursday that the execution of the plan of approach for justice was not progressing as it should. She didn't exclude that the several parts of the plans of approach for Curaçao and St. Maarten would be prolonged in June. She promised to keep Dutch Parliament informed on this.

‘Voluntary leave’ for 15 TelEm employees

PHILIPSBURG--TelEm Group management has confirmed that the company has granted "voluntary leave" to fifteen personnel of various departments within the TelEm Group. At the same time, management has denied five additional employees' requests for voluntary leave and has informed these employees accordingly.

In a press release Sunday, the TelEm Group management did not explain what was meant by "voluntary leave," but the decision is seen to be in keeping with the government-owned group of companies' bid to "right-size" itself by "downsizing" and operating with a reduced staff.

It was explained in the press release that the decision to grant voluntary leave had been taken by the group's Management Board on May 2 and 3, in continuing discussion with union representatives.

The TelEm Group explained that the Management Board believed the five employees not granted voluntary leave most likely could be placed in the new operating company (based on the company's Formation Plan) or that the TelEm Group reasonably could state that these persons otherwise would receive reasonable offers for functions in the new operating company.

TelEm has assured that the company's personnel and all stakeholders are being informed of these developments on an ongoing basis and have been told to expect other decisions in the restructuring process to be taken within the coming weeks.

TelEm Chief Financial Officer Helma Etnel said management viewed these latest developments as internal actions that it would be implementing in full consultation and discussion with the union and employees.

"This is a very sensitive time for all parties concerned and we trust that the public and the media will understand that we prefer to handle these matters internally and out of the public spotlight, in order to maintain the confidential nature of this process," Etnel said.

Inter-parliamentary consultation on hold

THE HAGUE--The Inter-parliamentary Consultation of the Kingdom, which had been scheduled for early June in The Hague, will most likely not go ahead due to the political situation in the Netherlands.

Chairwoman Second Chamber's Permanent Committee for Kingdom Relations Brigitte van der Burg discussed the fate the five-day meeting with the chairpersons of the Parliamentary Kingdom Relations Committees in Aruba, Curaçao and St. Maarten earlier this week.

Van der Burg informed the Committee for Kingdom Relations during a meeting on Wednesday, "Considering the fall of the Dutch cabinet, the pending elections and the changed political relations, we wondered whether there was any sense in continuing with this consultation," said Van der Burg.

According to Van der Burg, the chairpersons decided that they would all go back to their committee to discuss a calling-off of the consultation. "It is after all a costly affair for the islands to travel to The Netherlands for these meetings," she said.

Chairman of the Committee for Kingdom Affairs and Inter-Parliamentary Relations Roy Marlin stated due to the collapse of the Dutch Government and the planned elections that would bring possible changes in the composition of the Permanent Committee for Kingdom Relations in the Dutch Second Chamber, it was decided to propose to the respective inter-parliamentary committees to postpone the IPKO meeting until January 2013.

The chairpersons agreed to hold a video conference in late June to discuss the progress that has been made by the work groups in the different areas such as education, youth and youngsters, transport of goods and persons, and energy.

St. Maarten has indicated to Chairman André Bosman (VVD) of the work group Energy that it wants to be involved in the alternative energy projects that the Dutch Ministry of Economic Affairs, Agriculture and Innovation is arranging with St. Eustatius and Saba. It concerns geothermal and wind energy. St. Maarten has yet to respond to the work groups of Education and Youth and Youngsters.

In September, the Parliaments will decide when to hold the Inter-parliamentary Consultation. But the consultation will, in any case, not take place in the second half year of 2012, because of the hectic times in The Hague surrounding the elections in September and the formation period after.

Most probably the next Inter-parliamentary Consultation of the Kingdom will take place in January 2013, and because the meetings in the early part of the year are always held on the islands, it means that this year The Hague will not be hosting the event.

The State of the Kingdom has also been postponed. Initiative taker Member of Parliament Wassila Hachchi of the democratic D66 party said that holding the State of the Kingdom after the Inter-parliamentary Consultation in June proved impossible for technical organisational reasons.

Hachchi told The Daily Herald that the Chairpersons of the four Parliaments had discussed the State of the Kingdom. All Parliaments in principle were positive about her proposal. The Parliaments will continue the preparations to have the State of the Kingdom sometime next year.

Qtel group pushes for greater energy efficiency

Companies in the Qtel Group have been charged with increasing energy efficiency across their operations, following the pioneering Green Power for Mobile Regional Working Group meeting that took place in Qatar in April.

Energy efficiency is a key issue for companies across the Qtel Group, in particular the need to reduce diesel consumption where possible. In many remote and rural areas, diesel is the main source of power for towers and network stations, and the company is looking to reduce both costs and environmental impact by using energy more effectively.

GEBE share division to be completed in 18 months

PHILIPSBURG--The governments of Saba, St. Eustatius and St. Maarten have signed a Memorandum of Understanding (MOU) for the division of GEBE shares in eighteen months.

St. Maarten's Minister of Energy Affairs Theo Heyliger, Saba's Commissioner of Energy Chris Johnson and Statia's Commissioner of Energy Koos Sneek signed the MOU at the Government Administration Building in Philipsburg on Thursday evening.

With an action plan and with the shares transfer agreement of October 2011 incorporated into this MOU, the three islands now will enter an 18-month transition phase that will culminate in the division of shares and in Saba and Statia establishing their own electricity companies by January 1, 2014.

GEBE St. Maarten will buy out of Saba's 3.1 per cent and Statia's 4.5 per cent shares in GEBE to the tune of approximately US $15.2 million combined, so that St. Maarten becomes the 100 per cent owner of the company.

The Dutch Ministry of Economic Affairs has agreed to take up responsibility for affordable and reliable electricity in Saba and Statia after the transitional period ends on January 1, 2014.

The Dutch Ministry of Economic Affairs also has also made an interim manager available to assist Saba and Statia in establishing their own electricity companies, to draft business plans and to coordinate the construction of windmills on the islands. It is expected that the construction of these windmills will lower the production cost of electricity, which will have a positive effect on the tariffs.

An agreement also was reached pertaining to the rights and positions of the employees of N.V. GEBE who will be employed by the new electricity companies in Saba and Statia, as well as to capital investments and maintenance on the two islands during the transitional period.

The MOU now will be taken to the Council of Ministers of St. Maarten and the Island Councils of Saba and Statia for ratification. Once the MOU is ratified, GEBE's Shareholding Foundation will be instructed by all three governments, in a joint letter, to transfer the shares it controls back to all three islands.

When this process is complete, the Shareholding Foundation will be dissolved, as it currently serves no other purpose than the holding entity of the shares. A new Supervisory Board of GEBE then will be in control of the shares until they are divided.

This new board will be responsible for guiding the share transfer process and for the establishment of the companies in Saba and Statia, ensuring that these companies are able to operate independently and cost-effectively.

In the meantime, GEBE's operations will continue as is, with the exception of the appointment of new board members, which should happen soon, considering that two of St. Maarten's members on the current board, Joseph Dollison and Gregory Richardson, resigned recently.

St. Maarten's third member, board Chairman Julius Lambert, also has tendered his resignation, but has indicated that he will not leave until the end of his tenure on July 8. How the situation with Lambert will play out over the next few weeks is unclear, but the governments of St. Maarten, Saba and Statia have the right to appoint, suspend or dismiss board members.

The government had requested on March 12 that Shareholding Foundation Chairman Ralph Richardson seek the Supervisory Board's immediate resignation. Lambert indicated in response that he intended to remain for the duration of his contract. Saba and Statia will keep their current representatives on the board: Ivan Berkel representing Statia and Ray Hassell representing Saba.

The Daily Herald also understands that Statia's representative on the Shareholding Foundation Max Pandt also supports the MOU. He had some issues with the initial shares transfer agreement of October 2011.

Statia and Saba also have the support of the Dutch Ministry of Economic Affairs. An agreement was reached with the Ministry in March, when Commissioners Johnson and Sneek travelled to Holland to discuss the GEBE shares transfer.
