Brooks ignores Heyliger, goes on 60-day vacation

~ Board also non-responsive ~

PHILIPSBURG--Minister of Energy and Water Services Theo Heyliger said on Wednesday that he does not know whether he will receive answers to his many letters to GEBE, as its Managing Director William Brooks has departed on a two-month vacation.

Heyliger had informed Brooks via letter on July 19 that his level of compliance with the general conditions of the company were "very unacceptable" and had called on Brooks to take action on all outstanding subjects within 60 days from the date of the letter.

This would mean that Brooks would have had to provide answers by September 19.

However, noting that Brooks had gone on vacation for 60 days, Heyliger said, "So I can't say whether I will get any answers to my many questions." He said his only recourse would be to remind the Supervisory Board of GEBE, chaired by Julius Lambert, of its responsibilities to the company.

The board has been silent on the issues thus far and all efforts to reach Lambert have proven futile.

Heyliger made it clear in his letter that should Brooks not comply, government would "evaluate the use" of the cancellation instrument of GEBE's concession, the single instrument government has at its disposal to enforce compliance. Heyliger also instructed Lambert to "take immediate action to safeguard the interest of the company."

The board reportedly has not taken any action to date, as requested, and the minister stressed that given the importance of compliance with the law the Supervisory Board could be held co-responsible for GEBE's non-compliance.

He said the present situation with Brooks having been informed that his contract will not be renewed at the end of 2011 "further strengthens my view."
