Simpson Bay Resort says it will not sit with WIFOL

PHILIPSBURG--The Simpson Bay Resort Management Company (SBRMC) says it will not sit with the Workers Institute for Organised Labour (WIFOL), which extended an olive branch to engage in talks with the resort last week.

In a full page, which appears elsewhere in the paper, resort Director Mark Miller in an open letter to WIFOL President Theophilus Thompson said: "As Simpson Bay Resort has adequately outlined in its prior correspondence, it does not consider WIFOL to be the representative of its employees and as such will not engage into any discussion with WIFOL pertaining to its employees. WIFOL has been informed about the requisite procedure to become the representative of Simpson Bay Resort's employees."

Miller continued: "For good order's sake it should be noted that in December 2010 and in January 2011, when Simpson Bay Resort intended to offer employment to all the members of WIFOL that are employed with Pelican Resort Club, The Management Company B.V. (PRCMC), WIFOL through your person [Thompson ed.], explicitly informed Simpson Bay Resort not to approach its members individually, but to only address them through WIFOL. Consequently, Simpson Bay Resort extended employment offers to the members of WIFOL, through WIFOL. In the more than 300 hours of negotiations that followed, of which a substantial part in front of the Government Mediator, Simpson Bay Resort in chronological order made the following offers:

1. Employ all members of WIFOL who are employed with PRCMC against same salary and work conditions as with PRCMC, for a limited period of six months;

2. Employ all members of WIFOL who are employed with PRCMC against same salary and work conditions as with PRCMC, for a limited period of one year;

3. Employ all members of WIFOL who are employed with PRCMC against same salary and work conditions as with PRCMC, for a limited period of one year, with the guarantee that thereinafter at least approximately 140 persons would be reemployed.

"Despite extensive negotiations, none of these offers, whereby it is quite obvious that Simpson Bay Resort continued to make concessions in order to attain consensus and an amicable solution, regretfully met WIFOL's approval. The negotiations were subsequently closed by the Government Mediator, who concluded that parties regretfully could not reach an agreement.

"...As long as WIFOL is demanding that Simpson Bay Resort does not execute the prevailing verdicts of the Court of Appeals and also approach its members with concrete job offers, Simpson Bay Resort will refrain from making any job offer to the members of WIFOL. As time passes and considering the needs of the resort in not been high season, Simpson Bay Resort will be forced to start employing other persons on the island." More can be read in the SBRMC's ad.
